COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING THE FINAL PLAT OF SOMERSET 7T"
ADDITION.
ACTION FORM SUMMARY: The applicants, Erben Hunziker Revocable Trust, Donald and
Ruth Furman Revocable Trust, and R. Friedrich & Sons, Inc. are requesting the approval
of the Final Plat of the 7th Addition of Somerset.
Staff is recommending that this Final Plat be approved.
BACKGROUND:
The applicants, Erben Hunziker Revocable Trust, Donald and Ruth Furman Revocable
Trust, and R. Friedrich & Sons, Inc., are requesting that the City Council approve the Final
Plat of the 7th Addition of Somerset. The 71h Addition is located west of Stange Road in the
area that is planned to develop with townhomes. The proposed final plat contains a total
of 22 lots that range in size from 2,117 square feet to as large as 6,666 square feet. The
property in question is zoned R1-6 with a PUD overlay as part of the Zoning Change
Agreement applicable to Somerset.
ANALYSIS:
Staff has reviewed the submittal documents for this Final Plat and has determined that the
Final Plat meets the requirements of the subdivision regulations of the City. The developer
is requesting that the City Council approve this Final Plat even though none of the required
public improvements have yet been completely installed. The developer has provided a
Letter of Credit in the amount of$120,000 to insure that all required public improvements
are constructed. The developers have also signed a Public Improvement Agreement
guaranteeing the installation of all improvements that are necessary for this subdivision.
Based on this review, staff is recommending that the Final Plat for the 7th Addition to
Somerset be approved.
ALTERNATIVES:
1. The City Council can approve the Final Plat of the 7th Addition to Somerset.
2. The City Council can approve the Final Plat of the 7th Addition to Somerset with
modifications
3. The City Council can deny approval of the Final Plat of the 7tn Addition to Somerset.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve the Final Plat of the 7" Addition to Somerset.
