SUBJECT: Item No. 29: Hearing on Vacating Easement in Somerset Subdivision, 2nd Addition
There is an existing ten-foot public utility easement on the west side of Stange Road from Northridge
Parkway to Aspen Road. This easement directly interferes with the build-to requirements established for
Somerset Subdivision, 20'Addition.
Resolution of this type of conflict is normally handled in conjunction with the Final Plat approval for the
associated Subdivision. The Final Plat for Somerset Subdivision, 20th Addition,was approved on
September 27, 2005; however, when the conflict became apparent, it was too late to adequately publish
notice to vacate the easement in time for that meeting.
This easement is to provide space for private utilities (i.e.,phone, cable, gas) and is not under Public
Works control for installation of public infrastructure. In reviewing the documents submitted for
Somerset Subdivision, 20'Addition, the existing ten-foot public utility easement is being replaced with
a new five-foot public utility easement that does not conflict with the build-to requirements of this area.
