Book 12, Page 225, in the Office of the Recorder, Story County, Iowa; AND, That Part of the Southwest Quarter of the Southwest Quarter (SW'/4-SE'/4) of Section 27, Township 84 North, Range 24 West of the 5th P.M., Ames, Story County, Iowa lying Southwesterly of the Union Pacific Railroad; AND, That Part of the North Half of the Northwest Quarter (N'/2-NW'/4) of Section 34, Township 84 North, Range 24 West of the 5th P.M., Ames, Story County, Iowa lying Southwesterly of the Union Pacific Railroad. Route 438, locally known as George Washington Carver Avenue and along a 818.6 foot radius curve, concave Northeasterly, an arc distance of 1,235.80 feet(the long chord bears N 43007'40" W, 1,121.72 feet); thence N 00007'3 1" E, 505.86 feet along the West line of the NW'/4-NE'/4 to the Southwest (SW) corner of the Southeast Quarter (SE'/4) of Section 28, T84N-R24W of the 5th P.M., Ames, Story County, Iowa; thence N 00"19'02' W, 1,313.77 feet along the West line of the S'/2-SE'/4 of said Section 28; thence N 89°24'40" E, 2,585.87 feet along the North line of the S'/2-SEY4; thence S ql"-10678 �� 27051'25"E, 47.08 feet along the Westerly Right-of-Way of the Union Pacific Railroad as it is presently established; thence S 27'52'29" E, 1432.51 feet along said right-of-way to the North line of Section 34; thence N 89018'45" E, 16.87 feet;thence S 27052'29" E, 1499.32 feet along said right-of-way line to the South line of the Northwest Quarter of the Northwest Quarter (NWI/4-NWYa) of said Section 34; thence S 89'05'11" W along said South line a distance of 1371.97 feet to the Southeast Corner of the Northeast Quarter of the Northeast Quarter (NEI/4-NEI/4) of said Section 33; thence S 89°38'28" W, 1038.28 feet along the South line of the NEI/4-NEI/4;thence N 00021'32" W, 233.00 feet; thence S 89038'28" W, 249.24 feet; thence S 00010'19" E, 233.00 feet; thence S 89'38'28" W along the South line of the North Half of the Northeast Quarter of said Section 33 a distance of 21.50 feet to the Point of Beginning. Said tract of land contains 194.44 acres, more or less, to be known as SOMERSET SUBDIVISION FIRST ADDITION, AMES, STORY COUNTY, IOWA, and WHEREAS, the plat has been submitted to the Planning and Zoning Commission and it has acted thereon as provided by law, and WHEREAS, the owners of said real estate, Erben A. Hunziker, as Trustee of the Erben A. Hunziker Revocable Trust dated July 28, 1992; Donald M. Furman and Ruth W. Furman, as Trustees of the Revocable Trust dated March 1, 1991; R. Friedrich & Sons, Inc.; Ames Community School District; and Robert W. Taylor and Rosemary Taylor, husband and wife, have executed a written Consent and Dedication declaring that the platting is with their free consent and is in accordance with their desires as proprietors, and WHEREAS, the owners have complied with all conditions as set forth in the ordinances of the City of Ames, Iowa, and the laws of the State of Iowa, and WHEREAS, it is the opinion of the City Council of the City of Ames, Iowa, that the plat should be approved, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the plat of SOMERSET SUBDIVISION FIRST ADDITION, AMES, STORY COUNTY, IOWA, be and it is hereby accepted and approved, and 2 q7' 10678 C�a BE IT FURTHER RESOLVED that all of the acts of Erben A. Hunziker, as Trustee of the Erben A. Hunziker Revocable Trust dated July 28, 1992; Donald M. Furman and Ruth W. Furman, as Trustees of the Revocable Trust dated March 1, 1991; R. Friedrich & Sons, Inc.; Ames Community School District; and Robert W. Taylor and Rosemary Taylor, husband and wife, are hereby confirmed and approved. BE IT FURTHER RESOLVED that the dedication of Lots A, B, C, D, E, F, G, H, I and J and Outlots R, S, T and U, within said Subdivision for public street services be and the same is hereby accepted for and on behalf of the City of Ames, Iowa, and all acts of Erben A. Hunziker, as Trustee of the Erben A. Hunziker Revocable Trust dated July 28, 1992; Donald M. Furman and Ruth W. Furman, as Trustees of the Revocable Trust dated March 1, 1991; R. Friedrich & Sons, Inc.; Ames Community School District; and Robert W. Taylor and Rosemary Taylor, husband and wife, are hereby confirmed and approved by the City Council of the City of Ames, Iowa, on this 23rd day of September , 1997, provided that before the subdivision plat is presented to the recorder for recording, the said proprietors of the land to be platted shall delete from that instrument entitled Consent and Declaration, dated September 23, 1997, that sentence which refers to an agreement regarding the Wetland Reserve areas designated by the Iowa Department of Natural Resources.
