HomeMy WebLinkAboutA014 - Council Action Form dated January 27, 1998 Item # 9 Date: January 27, 1998 COUNCIL ACTION FORM SUBJECT: ABANDONING WEST 5' OF A 10' UTILITY EASEMENT ACROSS LOT 4 SOMERSET SUBDIVISION FIRST ADDITION (STERLING HOUSE-ASSISTED LIVING PROJECT) BACKGROUND: Eby Development is constructing an assisted living project for elderly residents on Lot 4 of Somerset Subdivision First Addition. The sideyard setback for this new building is 7 feet, which protrudes 3' into a 10' wide utility easement that was granted when the lot was platted. The developer has requested that the City abandon the west 5' of the easement to allow the building to be constructed as planned rather than reducing the building width. Staff has contacted electric, telephone, and cable T.V. utilities and they do not object to the reduction in width. ALTERNATIVES: 1. Grant the request and abandon the west 5' of the utility easement. 2. Reject the request and have the developer redesign the building. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council abandon the west 5' of the utility easement described as the east 10' of Lot 4 Somerset Subdivision First Addition Ames, Story County, Iowa.
