HomeMy WebLinkAboutA002 - Council Action Form dated August 16, 1983 fir►' ITEM # DATE: August 16, 1983 COUNCIL ACTION FORM SUBJECT: Auditors Plat of Riverside Heights BACKGROUND: On September 20, 1982, the Story County Auditor notified owners of property in three areas outside the city limits north of Ames that they must have their properties platted and recorded in the Court House. These three areas are all in the "Skycrest" area north of Ames and east of Hallett's Pit and US #69. The Auditor's Plat of Riverside Heights is one of these three areas. The other two areas will be forwarded to the City in the future. The owners of property in this plat did not comply with the Auditor's order and this has resulted in the Auditor hiring a professional engineer to create the plat. The engineering fees are charged against the lots in the plat. The City of Ames has not processed an Auditor's Plat for over ten years. An Auditor's Plat is provided for in Chapter 441.65 of the State Code. It is different from a Proprietor's Plat (Conceptual Development Plan/Admini- strative Plat/Final. Plat) which the City normally processes. An Auditor's Plat is a plat which is ordered by the County Auditor for assessment and taxa- tion purposes. It is a plat which recognizes existing lots which have not been previously platted. It does not create new lots. New lots must be processed through a Proprietor's Plat. An Auditor's Plat is.ordered when there is a need to clarify propergy descriptions and ownerships. An Auditor's, Plat is a one-step process. It does not .go through the CDP/Administrative/Final Plat process. The State Code grants to cities the jurisdictional control over Proprietor Plats within two miles of their corporate limits. Chapter 441.65 pertain- ing to Auditor's Plats does not address whether cities have any authority regarding approval of Auditor's Plats. However, a 1977 Iowa Attorney General's opinion states that cities are authorized to process Auditor's Plats. The Planning and Zoning Commission met and considered this plat at its meeting on July 6, 1983. It is their recommendation that the plat be approved and improvement requirements of the Subdivision Ordinance be waived-. Such improvements include paved streets, sanitary sewer, water, sidewalks, etc. City utilities are not available to the area and are not anticipated to be available in the foreseeable future. Additionally, it would not be appro- priate to provide a paved street and sidewalks in this area. If this area was annexed to the City in the future, improvements could be ordered in by the City Council and they would be paid for by special assessments or hookup fees. ALTERNATIVES: 1. To approve the Auditor's Plat of Riverside Heights and to waive the improvement requirements of the Subdivision Ordinance. 2. To not approve the Auditor's Plat of Riverside Heights. However, this is a plat ordered by the Auditor, and this may not .be a viable alternative. MANAGER'S RECOMMENDED ACTION It is recommended by the City Manager that the City Council approve the Auditor's Plat of Riverside Heights and waive the improvement requirements of the Subdivision Ordinance. SIZE AND NUMBER 'OF LOTS.- Total Subdivision -- 17.91 Number of Lots -- 6 Lot Size -- 1".00 ac. ; 1.00 ac. , 1.47 ac. , 3.12 ac. , 5.19 ac. , and 6.13 ac. ZONING AND LAND USE (County Zoning) : Subject Parcel - GB/C (Greenbelt/Conservation) and R-1 (Single Family) North - GB/C (Greenbelt/Conservation) and F-P (Flood Plain) South - F-P (Flood Plain) , County; and A-1 (Agricultural) , City East R-1 (Single Family) - West - GB/C (Greenbelt/Conservation) FINDINGS: Land Use Policy Plan The Land Use Policy Plan shows this area within the Urban Expansion Area and designates most of this area as agricultural/greenbelt. Public Utilities Water - Private water system Sanitary Sewer - Private septic tank Storm Sewer - Natural drainage Vehicular Access Access to the Subdivision is from Riverside Road. A common access drive is provided for Lots 1, 2, 3, and 4 from a driveway that is. part_ of Lot 3. This is -2- 7Z a 30-foot strip of land which extends to Riverside Road. This form of access is necessitated by the steep grade along Riverside Road. Lot 5 has its own access to Riverside Drive and access to Lot 6 is from the property to the west. Physical Characteristics Vegetation - Much of the area is wooded; there is natural vegetation found along streams and stream banks. Terrain - West of the Skunk River the terrain is generally quite flat; east of the Skunk River there is a steep slope up from the river; the upland portion of this property is gently sloping with steeper slopes along Riverside Road. Drainage - This property drains to the southwest toward the Skunk River and to the northwest and north toward Riverside Drive. Soils - Soils in the area include Sparta and Hanlan. The Hanlan soils are subject to flooding and the Sparta soils are found in moderate to steep slopes. Flooding - Lots 1, 2, 3, and 4 have buildable areas that are not subject to flooding. Lots 5 and. 6 are in the flood plain of the Skunk River. ANALYSIS: 1. The area described as Lots 3 & 4 in this Auditor's Plat of Riverside Heights were before the Planning and Zoning Commission in November and December of 1982 for a rezoning of a portion of that property from GB/C (Greenbelt/Conservation) to R-1 (Single Family) . The Commission recommended that the change be approved. The Board of Supervisors has approved the rezoning. 2. The Auditor has ordered that this property, known as Auditor's Plat of Riverside Heights, be platted by professional engineers. The Auditor requires an Auditors Plat to be made when a definite and accurate description of an individual piece of property is necessary for assessment and taxation purposes. In this case, the dividing line between Lots 5 and 6 was described as the centerline of the Skunk River. Since the river shifts, this is an imprecise definition. In addition, the descriptions of each of the other parcels, using metes and bounds, were unusually long and difficult to understand. The Auditor's Plat clears up the description of this area and makes it. easier for the Auditor to refer to it for taxation purposes. An Auditor's Plat does not create any new parcels, but provides a clear description of the existing division of property. 3. Since the Auditor's Plat is a description of the property as it currently exists and a new subdivision is not being created, it is recommended that the requirements of the Subdivision Ordinance be waived. RECOMMENDATION: The Department recommends that the Auditor's Plat for Riverside Heights be approved and requirements for improvements be waived. GB/C4istrict Boundaryla re ti U.
