RESOLUTION NO. 16-084
RESOLUTION APPROVING VACATION OF PUBLIC UTILITY EASEMENT
FOR 3121 GRAND AVENUE
FOR THE CITY OF AMES,IOWA
WHEREAS, there is an existing Electric Utility Easement on the property located at 3121 Grand
Avenue; and,
WHEREAS,the property owner made a request to vacate the Electric Utility Easement; and,
WHEREAS,pursuant to Iowa Code Section 364.7,notice was given on February 16, 2016, and a
public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7,publication of notice regarding the proposed vacation
of the public utility easement and establishing a public hearing date regarding the proposal has been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The existing Electric Utility Easement across the following described land is hereby vacated:
"Commencing at the NW corner of Lot 1 of Northwood Plaza,First Addition,to the City
of Ames, Iowa, in the 5th PM, thence south 232' thence east 10' to the point of
beginning,thence east 50',thence north 12',thence west 50',thence south 12'to the point
of beginning as shown on the final plat recorded April 11, 1990,Instrument No. 06517,
book 265, page 64. Also recorded as Instrument No. 06516 recorded April 11, 1990,
book 9, page 106."
ADOPTED THIS 23rd day of February, 2016.
