COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING THE FINAL PLAT OF RICHARDSON'S
SUBDIVISION.
ACTION FORM SUMMARY: The applicant, Lowell and Doris Richardson, are proposing
to create a two lot subdivision on a parcel of property located in the Southdale area
between Opal Drive and Emerald Drive. This proposed subdivision is being processed as
a minor subdivision.
Staff recommends that this minor subdivision be approved.
BACKGROUND:
The applicant, Lowell and Doris Richardson, are requesting that the City approve a Final
Plat of a two lot minor subdivision. The property in question is located between Opal Drive
and Emerald Drive in the Southdale area. The property that is being proposed to be
subdivided has never been part of an official plat. The parcel in question is zoned R-10.
Currently there is a single family home that is located on proposed Lot 1.
Each lot that is proposed meets or exceeds the requirements of the R1-10 zoning district.
ANALYSIS:
The applicant is requesting that the requirement for sidewalks, as provided for in Section
23.403(14), be waived. Attached to this Action Form is a more detailed explanation from
the applicant relative to this waiver request.
Staff has reviewed this request for a minor subdivision approval and has determined that
the requirements of the zoning ordinance and subdivision regulations have been satisfied.
With respect to the sidewalk, the applicant has developed several reasons why a sidewalk
should not be required for this subdivision. These reasons, as well as a staff response,
include the following:
♦ The existing garage is too close to the right-of-way and cars will extend into the
sidewalk area.
Staff Response:
Although cars may be parked where they would extend over the walk, the
cars could also be parked in the garage, thus making the walk available
to pedestrians without obstruction.
♦ A number of lilacs would have to be removed.
Staff Response:
This may be unfortunate, but lilacs are not a permitted plant species in
public right-of-way. Additionally, lilacs could be replanted on private
property to result in the same condition.
♦ The walk would terminate in a ditch.
Staff Response:
This condition may be the case for the time being, but the installation of
sidewalks should be seen as the development of a system that may take
a long time to complete, and walks through the ditch in the future could
occur to complete the system in this area.
♦ The cost.
Staff Response:
The cost estimate for the installation of the walks does not seem to be
excessive for the length of walk contemplated. Other property owners
have incurred similar costs for similar lengths of walks.
♦ Liability for snow and ice removal in the winter.
Staff Response:
The problem of snow removal is similar to other property owners who
leave Ames during the winter months. Arrangements are made to
address the need for snow removal.
Staff recommends that the request to waive the sidewalk requirement not be waived.
ALTERNATIVES:
1. The City Council can approve the Final Plat of the Richardson Subdivision.
2. The City Council can refer this request back to staff for additional information.

MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve the Final Plat of the Richardson Subdivision. Additionally, staff is
recommending that the City Council not waive the requirement for the installation of
sidewalks.

We request a waiver from constructing sidewalk for the following reasons:
Loss of off-street parking at 3504 Emerald. The garage has a setback from the lot line
of 15 ft., therefor with the one ft. offset from the lot line for the sidewalk,there would be
only 16' in the drive for parking of a vehicle without it being over the sidewalk. We try
to avoid parking in the street and this would prohibit us from parking in our own drive
without violating the ordinance against parking over the sidewalk.
Lilac bushes would have to be removed.A 45 ft. row of mature lilacs on the lot at 3508
Emerald and a 15 ft. row on the lot at 3504 Emerald would have to be removed to
permit sidewalk construction.
Would terminate at.a ditch.The south end of the sidewalk would terminate at a ditch
and an intake.
Little likelihood for construction on further south.The area on the south is a tall
thick hedge that would be difficult to remove to permit sidewalk construction.
Cost. The cost of the sidewalk would be in excess of$1000 for each lot. Naturally we do
not want to incur that expense if we don't have to.
Liability for snow and ice removal in the winter. Probably my biggest concern is that
it will be necessary to remove ice and snow during the winter months. We are gone for at
least four months during the winter and since the house at 3504 Emerald sits empty
during that time, there is no necessity to even clear the driveway. Having to clear the
walk would be a big concern to us.
