HOLM, hereby state that I am an Attorney at Law, duly admitted to the practice of law in the State of Iowa, and a member of the firm of SINGER, PASLEY, HOLM, TIMMONS, MATHISON & 'CURTIS, with offices at 323 Sixth Street, Ames, Story County, Iowa. I further state that I have examined the abstract of title to the following described real estate: Lot 9, Landmark Subdivision of Ames, ' Iowa; AND Part of the right-of-way of Old , U.S. Highway #30 in the Northeast Quarter of the Northeast Quarter of Section 7, Township 83 North, Range 24 West of the 5th P.M. , more particularly described as follows: commencing at the Northeast corner of said Section 7; thence S8903814411W, 49. 00 feet along the North line of said Section 7; thence SO°00' 00"W, 100. 00 feet along a line that is parallel with the East line of the Northeast Quarter of said Section 7 to the point of beginning; thence continuing S000010011W. 149. 12 feet to a point on the Southerly right-of-way of Old U.S. Highway #30; thence N704415811W, 7.42 feet along said right-of-way; thence N6401215911W, 138. 09 feet along said right-of-way; thence Northwesterly, 188.49 feet along said right-of-way, along a curve having a radius of 1392 .50 feet, -concave Southwesterly through a central angle of 704512111, and having a chord which bears N6801315711W for 188. 35 feet; thence N8803412211W, 4 .73 feet along said right-of-way; thence N000010011W, 9.86 feet to a point that is 100.00 feet South of the North line of the Northeast Quarter of said Section 7; thence N8903814411E, 305. 00 feet to the point of beginning. Said real estate is also described as Parcel "A" as shown on the Plat of Survey filed for record on the 27th day of February, 1991, in Certificate and Field Notes Book 9, Page 247 in the office of the Story County, Iowa Recorder; from the date of the Root of Title thereof, down to and including the Ad dall day of 1991, last certified by Cyclone Abstract & Title Co. The real estate has been -subdivided and is now known as QUIKTRIP SUBDIVISION OF AMES, IOWA. Fee simple title to: Parcels "A" and "B" as shown on the Plats of Survey filed for record on the 27th day of February, 1991, in Certificate and Field Notes Book 9, Page 247, and in Certificate and Field Notes Book 9, Page 248, respectively, in the office of the Story County, Iowa Recorder, (Said real estate is to be known as Lot 1, QuikTrip Subdivision of Ames, Iowa) , is in QUIKTRIP CORPORATION; 2. Fee simple title to: Lot 9, Landmark Subdivision of Ames, Iowa, EXCEPTING THEREFROM Parcel "B" as shown on the Plat of Survey filed for record on the 27th day of February, 1991, in Certificate and Field Notes Book 9, Page 248, in the office of the ' Story County, Iowa Recorder, (Said real estate is to . be known as Lot 2, QuikTrip Subdivision of Ames, Iowa) , is in ERBEN A. HUNZIKER and DONALD M. FURMAN; 3 . Said real estate is free from encumbrances; and 4.
