SUBJECT:
Resolution Approving a Conceptual Development Plan (CDP) for Qui_kTrip
Subdivision Located at 4506 Lincoln Way.
ACTION FORM, SUMMARY: This is a two (2) lot subdivision that involves
the purchase of City right-of-way and the division of an existing
platted lot to create two (2) separate lots. Lot 1 will be used for
the relocation of a convenience store and Lot 2 is currently vacant
except for an existing residence. A change in the LUPP and a rezoning
of Lot 1 along with approval of a P-C Plan are necessary for the relo-
cation of the convenience store. Staff recommends approval of this CDP
with the following stipulations: (a) that the developer pay for the
acceleration/deceleration lane on Lincoln Way; (b) that the developer
pay for the new bike paths along Lincoln Way and along the east side of
Lot 1 and require that the bike path be extended along the east side of
Lot 2 to Todd Drive at the time of development of Lot 2; and (c) that
the developer purchase from the City that part of the right-of-way
which is part of Lot 1.
BACKGROUND:
This proposed two (2) lot subdivision involves a replat of Lot 9 in the
Landmark Subdivision and a portion of the City right-of-way that is no
longer used for street purposes. The proposed subdivision is located in a
block, bounded by Lincoln Way on the north, South Dakota Avenue on the
east, Todd Drive on the south, and Alcott Avenue on the west.
Platting of this property was necessary for two (2) reasons. The first
reason is that Lot 1 is a combination of a portion of a platted lot and
unplatted ground which is currently right-of-way. Platting would serve to
clarify the description of this new lot and the remaining part of Lot 9. In
addition, Lot 9 of Landmark Subdivision has already been described as two
(2) pieces of ground in order to separate the existing residence from the
remainder of the lot for tax purposes, although there is one (1) owner for
both these parts of Lot 9. State law requires that any time a parcel is
split into three (3) parts, platting must take place. As a result of the
previous separately described two (2) parcels in Lot 9 and the intent to
sell another part of Lot 9 to create Lot 1 is also triggered by this occur-
rence. [Note: The owners of the proposed Lot 2 intend to consolidate
this parcel back into one (1) lot without separating out the parcel contain-
ing the existing structure. ]

The intended use of the property in this subdivision is a convenience
store on Lot 1 and future multiple-family development on Lot 2. The
existing QuikTrip store located east of South Dakota Avenue and south of
Lincoln Way desires to move to this new location because of the construc-
tion of the new median in South Dakota Avenue which makes direct left
turn movement into that site impossible for southbound drivers. The
QuikTrip Corporation is also seeking a change in the Land Use Policy Plan
for the proposed Lot 1 from Residential: Medium Density to Commercial, a
zoning change from R-3 (Medium-Density Residential) to P-C (Planned
Commercial), and approval of a P-C Plan for the development of the site.
ANALYSIS:
Land Use Policy Plan. The Land Use Policy Plan (LUPP) designates this
site as suitable for medium-density residential. The developers have
requested a change in the Land Use Policy Plan from medium-density '
residential to commercial for the proposed Lot 1 in order to allow the
construction of a convenience store.
Zoning History. This property is currently zoned R-3 (Medium-Density
Residential). The developers are seeking rezoning of the proposed Lot 1
from R-3 (Medium-Density Residential) to P-C (Planned Commercial). The
proposed two (2) lot sizes are consistent with the current and proposed
zoning designations for this property.
Utilities.
Water: There is a 16-inch water main in the east side of South
Dakota Avenue which will serve Lot 1. An eight-inch water main in
Todd Drive along with the eight-inch water main in South Dakota
Avenue which: will provide service for Lot 2.
Sanitary Sewer: An eight-inch sanitary sewer main is located in the
west side of 'South Dakota Avenue which will serve Lot 1. Eight-
inch sanitary sewer mains in Raphael Avenue and Sinclair Avenue
terminate at the south property line of Lot 2 and would be available
to serve the development in Lot 2.
Storm Sewer: There is a storm sewer intake northeast of Lot 1, and
there are several storm sewer intakes in Todd Drive which will serve
Lot 2.
Electric: There is adequate electric power to serve this site. New
electric power lines along the south side of Lincoln Way adjacent to
this property will be rebuilt in the near future.
Streets and Vehicular Access. Access to Lots 1 and 2 from Lincoln Way
will be via a mutual access easement located on Lot 2, and no other access
from Lincoln Way will be allowed. This easement is 35 feet wide, and it
extends south 208 feet along the west side of the proposed Lot 1. A new
acceleration/deceleration lane in Lincoln Way will be installed by the
developer adjacent to this subdivision to facilitate the use of this access
easement. Traffic. movement into and out of the site on Lincoln Way will

be by right turn in and right turn out movement only. As part of the
mutual access easement agreement the developer of Lot 1 will be required
to narrow the driveway into his property off of the mutual access easement
to 35 feet when Lot 2 is developed in order to better channelize traffic
movement into and out of Lot 1 to prevent potential traffic conflicts with
traffic movement from Lot 2.
Another driveway is planned for Lot 1 off of South Dakota Avenue opposite
the Lincoln Swing intersection and south of the median in South Dakota
Avenue. This driveway will enable both left and right turns into and out
of the Lot 1.
As a result of the addition of the acceleration/deceleration lane in Lincoln
Way, the existing traffic signal will have to be moved at the southwest
corner of Lincoln Way and South Dakota Avenue. The cost of moving the
traffic signal.will be at the developer's expense.
Additional vehicular access will be available for Lot 2 from South Dakota
Avenue, Todd Drive, and Alcott Avenue.
A new bike path will be reconstructed along the shoulder of Lincoln Way
and the developer of Lot 1 will extend another bike path along the east
side of Lot 1 along the west side of South Dakota Avenue. A future bike
path is planned along the west side of South Dakota Avenue south of Lot 1
which will be installed at the time of the development of Lot 2.
Planning and Zoning Commission Recommendation. The Planning and
Zoning Commission reviewed this request at their meeting of November 7,
1990, and recommended that it be approved.
ALTERNATIVES:
1. The City Council can approve of the CDP for Quik.Trip Subdivision
with the following stipulations:
A. That the developer pay for construction of the new accelera-
tion/deceleration lane in Lincoln Way;
B. That the developer pay for the construction of the new bike
path along Lincoln Way and along the east side of Lot 1 and
that the future bike path along the east side of Lot 2 be
installed at the time of the development of Lot 2;
C. That the developer purchase from the City that part of the
existing right-of-way shown in the northeast part of Lot 1
prior to the approval of the Administrative Plat; and
D. That the developer pay for moving the traffic signal at the
southwest corner of Lincoln Way and South Dakota Avenue.
2. The City Council can deny approval of the CDP for QuikTrip
Subdivision.

3. The City Council can table this request for additional information
from the developer or City staff.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt
Alternative #1. This will approve of the CDP with stipulations that the
developer pay for the cost of the acceleration/deceleration lane, pay for
the construction of bike paths abutting Lot 1 and agree to extend the bike
path on the east side of Lot 2 at the time of development and that the
developer purchase from the City that part of the right-of-way which is
part of the proposed Lot 1. This will also allow the developer to proceed
with the platting process.
