EACRET FOR SHARING COSTS OF PLATTING A SUBIVISION OF LAND ON PULLMAN STREET THIS-AGREEMENT made and entered into this 20th day of July 1982, by and between the City of Ames, Marion T. Eacret and Joyce M. Eacret, WITNESSEI'H: WHEREAS, the City of Ames owns a part of a tract of land, the subdivisions of which are required by Iowa law to be platted for record, and, WHEREAS, the City of Ames should share equitably with the other owners of said tract in the costs of making the required official plat for record; and, WHEREAS, Marion T. Eacret and Joyce M. Eacret, owners of another parcel of said tract, have begun the process of platting subject to agreement by all owners of said tract to share in their costs and attorney's fees in so doing; NOW, THEREFORE, the partners hereto have agreed and do agree that: 1. The City of Ames shall pay to Marion T. Eacret and Joyce M. Eacret, or their designee, its proportionate share, based on the ratio of lot front footage the City owns as compared with the lots owned ,by the other owners, (all are shown in Exhibit "A" attached) of the costs, survey work, legal fees and drafting of plats in the platting of record of land on the north side Pullman Street as shown on said attached plat. 2. The City's payment will not be made until the platting is approved and filed for record in accordance with the laws of the State of Iowa and the ordinances of the City of Ames. 3. The estimated range of the amount for the City of Ames' propor- tionate share of costs as aforesaid is between $412.50 and $571.15. In no event and under no circumstances will the City's payment obligation hereunder exceed the sum of $571.15. 4. The Mayor of the City of Ames is authorized to execute in behalf of the City, as an owner of real estate within the proposed subdivision, the Consent and Dedication for. such platting. 5. It is expressly agreed that with respect to the platting of said Subdivision, the City shall make no requirement for paving, curb and gutter, sidewalks, or the extension of sanitary sewer westward from its present location at Whitney Avenue. 6. Marion T. Eacret and Joyce M. Eacret shall proceed forthwith in platting the subdivision as aforesaid. CITY B F.
