HomeMy WebLinkAbout~Master - Title VI Non-Discrimination Agreement with IDOT RESOLUTION NO. 16-005 RESOLUTION APPROVING TITLE VI NON-DISCRIMINATION AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR THE CITY OF AMES WHEREAS, Title VI of the Civil Rights Act of 1964 prohibits agencies receiving federal funds from discriminating on the basis of race, color, and national origin; and, WHEREAS, since 1964, protections under federal law have been expanded, as have the compliance requirements for agencies receiving federal funds; and, WHEREAS,the City maintains a Title VI Compliance Plan and complaint procedure,which are designed to prevent and remediate discrimination; and, WHEREAS, because the City receives a substantial amount of federal funds through transportation projects,the Iowa Department of Transportation(IDOT) has been tasked with reviewing the City's compliance with Title VI requirements; and, WHEREAS,a compliance visit was held in December,and the IDOT has recommended that the City take an immediate action to maintain compliance with its requirements; and, WHEREAS,the Title VI Non-Discrimination Agreement with the IDOT needs to be adopted as agencies with a population of less than 250,000 are required to adopt this Agreement; and, WHEREAS, although the City of Ames has a Title VI plan,this plan does not incorporate some of the complaint procedure processes incorporated in the Title VI Non-Discrimination Agreement, such as automatically forwarding complaints to the IDOT within a certain time frame; and, WHEREAS,adopting this Agreement requires the City to use the Title VI complaint investigation and resolution process outlined by the IDOT,rather than the process developed independently by the City for this purpose; and, WHEREAS,the City would keep its Title VI plan,but those seeking the complaint process would be directed to follow the process outlined by the IDOT. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the Title VI Non-Discrimination Agreement with the Iowa Department of Transportation is hereby approved.
