r&O KNOW ALL MEN BY THESE PRESENTS:
w e That Phil Coy and Sons, a partnership composed of Jack Coy and
LU C �. Richard Coy, and Broadmoor Enterprises, Inc, an Iowa Corporation hav-
>_ W ing its principal place of business in the City of Ames, Story County, Iowa,
bm for and in consideration of the sum of One Dollar, receipt of which is here-
by acknowledged, does hereby grant to the City of Ames, Story County,
Iowa, its successors and assigns:
1. The perpetual right to construct, reconstruct, operate and main-
tain electric lines, consisting of_poles,_wir.es, cables, conduits, fixtures,
anchors and.other similar equipment, including the right'to trim or remove
trees within such area where necessary to secure clearance of four feet
from the wires or poles.
2. The perpetual right to construct, reconstruct, alter, operate
and maintain water lines and appurtenances thereto, sanitary sewers and
appurtenances thereto, . and storm sewers and appurtenances thereto.
3. The perpetual right to construct, reconstruct, alter, operate
and maintain telephone wires, poles, cable risers and appurtenances
thereto.
4. The perpetual right to construct, reconstruct, alter, operate
.and maintain gas lines and appurtenances thereto, together with the right
to extend to telegraph, telephone, electric, or power companies or any
company the right to use separately or jointly with the City of Ames, the
areas included in this easement for the purposes above enumerated, over,
upon, across or under the following described real estate situated in the
County of Story, State of Iowa, to-Wit:
The West Five (5) feet of Lots. 1 , 2, 3, 4, 5, 6, 7, 8, 9, 14,
15, 19, 21, 22, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34 and 35;
The East Five (5) feet of Lots 21, 22, 26, 27, 28, 29, 30, 31 ,
32, 33, 34 and 35;
The East Six (6) feet of Lots 1 and 2;
The East Ten (10) feet of Lots 3, 4, 5, 6, 7, 8, 13, 14, .15,
16 and 17;
The North Five (5) feet of Lots 8, 20, 22, 23 and 28;
The South Five (5) feet of Lots 7, 9, 10, 11 , 23, 24, 25 and
29;
The South Ten (10) feet of Lots 17, 18 and 19;
'V The East Sixty (60) feet of the North Ten (10) feet of Lot 10;
The North Ten (10) feet of Lots 11 and 12;
The front five (5) feet (along the street) of Lots 12, _13, 16,
17, 18, 19, 24, 25 and 26; .
A 10 foot wide strip the centerline of which is the boundary
line between Lots 17 and 18 and extending t-he entire length
of.said boundary lines; -

That part of Lot 9 described as a five (5) foot wide strip par-
allel to and adjacent to (along the street) the Southwest bound-
ary line of said Lot;
That part of Lot 22 described as a five (5) foot strip parallel
to and adjacent to (along the street) the Northeast boundary
line of said Lot; and
That part of Lot 20 described as a five (5) foot strip parallel
to and adjacent to (along the street) the Southeast boundary
line of said Lot,
All in First Addition, Prairie View Subdivision to Ames, Iowa, and
as shown on the Plat of said Addition.
The foregoing rights are granted upon the express condition that
the 'City of Ames, will assume responsibility for all damage to the above
described property caused by the City's failure to use due care in the
exercise of its granted right.
