RESTRICTIVE COVENANTS
PETE COOPER SUBDIVISION, SECOND ADDITION,
AMES, IOWA, A REPLAT OF LOTS 8 AND 91
PETE COOPER SUBDIVISION, AMES, IOWA
WHEREAS, the undersigned are the owners in fee simple of
Lots One (1) through Seven (7) , inclusive, and Outlot "A" of PETE
COOPER SUBDIVISION, SECOND ADDITION, AMES, IOWA, A REPLAT OF LOTS
8 AND 9, PETE COOPER SUBDIVISION, AMES, IOWA, and
WHEREAS, for their protection as owners and for the
benefit of subsequent owners of said lots, the undersigned desire
to restrict the use thereof in certain particulars,
NOW, THEREFORE, the undersigned hereby covenant, bargain
and agree for themselves, their successors in interest and assigns,
that Lots One (1) through Seven (7) , inclusive, and Outlot "A" of
PETE COOPER SUBDIVISION, SECOND ADDITION, AMES, IOWA, A REPLAT OF
LOTS 8 AND 91 PETE COOPER SUBDIVISION, AMES, IOWA, shall be subject
to the following covenants, conditions and restrictions:
1. MUTUAL DRIVEWAYS. Shared access or mutual driveways
for motor vehicle ingress and egress are required for Lots 1 and
2, for Lots 4 and 5, and for -Lots 6 and 7.

2 . ACCESS FOR LOT S. Access for motor vehicle ingress
and egress to and from Lot 5 shall be to Southeast Fifth Street
only and such access shall not be permitted to and from South
Dayton Avenue.
3. SOIL BORINGS. In those areas where the City of
Ames, Iowa, has identified as having soils that make construction
of buildings difficult, soil borings shall be required.
4. BUILDING SETBACK LINES. All lots within the
subdivision shall be subject to building setback lines as
identified on the final plat.
5. VIOLATIONS. In the event of the violation of any
of these covenants, conditions and restrictions, any person or
entity then owning a lot within the subdivision or the City of
Ames, Iowa, is authorized to resort to an action at law or in
equity for relief, either by injunction or in damages, against the
person, persons or entity violating these provisions, or for
specific performance in complying with said covenants, conditions
and restrictions.
6. INVALIDATION. The invalidation of any one or more
of these provisions by judgment or order of Court shall not affect
the other provisions which shall remain in full force and effect.
7. DURATION. The provisions of this instrument shall
run with and be binding upon the land embraced herein for a term

of twenty-one (21) years from the date of the filing of this
instrument in the office of the Recorder of Story County, Iowa.
