RESOLUTION DIVIDING ASSESSMENTS MADE AGAINST
LOT 1 OF PETE COOPER'S SUBDIVISION BETWEEN FIVE
PARCELS NOW PLATTED AS LOTS 1 THROUGH 5 OF
EAST LINCOLN WAY DEVELOPMENT SUBDIVISION
WHEREAS, the Ames City Council has previously levied special assessments #71, tract
#25579 (S.E. 5th Street Improvement) and#75, tract#25602 (E. Lincoln Way Res.) against Lot 1
of Pete Cooper's Subdivision, Ames, Iowa; and,
WHEREAS, the unpaid amount remaining on these assessments after the March 2002
payment totals $39,434.30; and,
WHEREAS, the said Lot 1 of Pete Cooper's Subdivision has been platted into Lots 1
through 5 of East Lincoln Way Development Subdivision; and,
WHEREAS,the County Auditor's office has requested that the City Council divide,using
the authority granted in Section 384.61 Code of Iowa, the unpaid amount of the said special
assessments between the aforesaid five lots of East Lincoln Way Development Subdivision; and,
WHEREAS,the lien in favor of the City,arising under paragraph 5 of Section 364.65 Code
of lowa against the said real estate for the unpaid amount of the assessments shall not be affected
by the proposed division;
NOW,THEREFORE,IT IS HEREBY RESOLVED,by the City Council of the City of
Ames, Iowa, as follows:
1. Special Assessment#71,tract#25579,in the unpaid amount of$30,143.10 and#75,
tract 25602 in the unpaid amount of$7,299.25 are hereby divided,respectively,to parcels as follows:
a) Lot 1, East Lincoln Way Development Subdivision (tax parcel #09 12 201
240) the amount of$1,754.70.
b) Lot 2, East Lincoln Way Development Subdivision (tax parcel #0912201
230)the amount of$2,041.80.
c) Lot 3, East Lincoln Way Development Subdivision (tax parcel #09 12 201
210) the amount of$2,041.80.
d) Lot 4, East Lincoln Way Development Subdivision (tax parcel #09 12 201
220) the amount of$1,460.95.
e) Lot 5, East Lincoln Way Development Subdivision (tax parcel #09 12 251
210) the amount of$30,143.10.
2. The City Clerk is hereby authorized and directed to certify the aforesaid separate
special assessments to the Treasurer of Story County, Iowa, for collection over the remaining life
of the original assessment in the same manner as though levied originally upon the five separate
tracts of land. A copy of this resolution certified by the City Clerk as a true copy is to be filed with
the Story County Recorder, and the Story County Auditor, as well as the Story County Treasurer,
to show the division of the assessments.
