I, Steven J. Oeth, hereby state that I am a licensed Attorney
at Law, duly admitted to the practice of law in the State of Iowa,
and a member of the law firm of Payer, Hunziker & Cossitt, with
offices at 535 Main Street, Ames, Iowa 50010. I further state that
on April 23, 1991 I examined the abstract of title to the real
estate shown on the Final Plat of the Fourth Addition to Orchard
Estates Subdivision to the City of Ames, Story County, Iowa,
prepared by Kenneth D. Janssen in September of 1990, which real
estate is more particularly described as follows, to-wit:
A part of Lot 5 in the E 1/2 of the SE 1/4 in Section 32,
Township 84 North, Range 24 West of the 5th P.M. , in the
City of Ames, Story County, Iowa, described as follows:
Commencing at the SE corner of the SE 1/4 of Section 32,
Township 84 North, Range 24 West of the 5th P.M. , in the
City of Ames, Story County, Iowa; thence West 947 .50 feet
along the South line of the SE 1/4 of said Section 32;
thence N 00021,10" E, 893.02 feet to the Southwest corner
of the First Addition of Orchard Estates Subdivision;
(the following calls are along the perimeter of both the
First and Third Additions of Orchard Estates Subdivision)
thence S 89 35'00" E, 272 .20 feet; thence S 5 0P 25'30" E,
43. 15 feet; thence S 67027 '0011 E, 88.84 feet; thence S 340
42145" E, 96 .06 feet; thence S 50025130" E, 260. 80 feet;
thence S 20030 ,00" W, 140.00 feet to the southwest corner
of the said Third Addition; thence N 85005 ,101, W, 598.70
feet along the north line of the Chicago & Northwestern
Transportation Company Right of Way; thence N 000211101,
E, 388.76 feet along the west line of Lot 5, in the E 1/2
of the SE 1/4, to the point of beginning.
Said abstract is from the root of title last certified by the
Cyclone Abstract & Title Co. , Ames, Iowa, to thelP=4th day of
f ja y, 1991, at 8:00 O'clock A.M. and I find merchantable title
as follows: Erben A. Hunziker and Margaret H. Hunziker, husband
and wife, and Donald M. Furman and Ruth W. Furman, husband and
wife, free from encumbrances except utility easements.
