Hunziker, husband and wife, and Donald M. Furman and Ruth W. Furman, husband and wife, of the county of Story, state of Iowa, for and in consideration of the sum of one dollar ($1.00) and other valuable considerations to the undersigned in hand paid by the CITY OF AMES, IOWA, a municipal corporation, the receipt of which is hereby acknowledged, has granted, sold and conveyed, and by these presents does grant, sell and convey, unto the City of Ames, of the county of Story, state of Iowa, an easement for the passage of pedestrian traffic, attendant drainage, and customary vehicles and equipment for the construction and maintenance of a w pathway for pedestrian traffic, over, under, through, across, and along all that C certain tract or parcel of land described as: West Eight (8) Feet of Lot Thirty-three (33) ,; Ontar,i o__W_est, ?First Addition to Ames, Iowa. -Wand shown on the plat attached hereto and by this reference made a part hereof. 0 The City is granted these property rights for the purpose of constructing and maintaining a public trafficway for the passage of pedestrian traffic, and it 4. shall have the right to make the improvements on that grade according to such .WT plans and specifications as will , in its opinion, best serve the public purpose. Cd .W The payment of the aforesaid purchase price is received and accepted as full °a compensation and satisfaction for the property conveyed, and for any damage or W any diminution in value that may result to the remaining property by virtue, of 9. proximity to the project, grade, or alteration of drainage patterns. To have and to hold the same, together with all the rights and appurtenances belonging thereto, unto the City of Ames, its successors and assigns forever, c and grantors are hereby bound, together with all heirs, executors, administra- tors, successors or assigns to warrant and forever defend the easement unto the City of Ames against every person claiming the easement or making any claim adverse to said easement. cI EXECUTED this day of 1991.
