HomeMy WebLinkAboutA008 - Utility Easement dated December 1, 1977 0 UTILITY EASEMENT KNOW ALL MEN BY THESE PRESENTS: That Ev Cochrane & As- sociates, .Inc. , a corporation organized and existing under the laws of the State of Iowa and having its principal place of business in Story County, Iowa, in consideration of One Dollar and other good and valu- able consideration, does hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use electric lines, consisting of poles, wires, cables, conduits, fixtures, anchors and similar equip- ment, including the right to trim or remove trees within such area where necessary to secure a clearance of four feet from the wires or poles, to- gether with the right to extend to telephone, telegraph, electric or power companies, the right to use separately or jointly with the City of Ames, Iowa, the areas included in this easement for the purposes of extending utility services over, upon, across or under the following described real estate, situated in the County of Story, State of Iowa, to-wit: All areas, either 5 feet wide or 10 feet wide, adjacent to the perimeter boundaries of certain lots in Oakwood First Addition to the City of Ames, Iowa, as shown on the Final Plat thereof and designated as telephone and electrical util- ity easements. Ev Cochrane & Associates, Inc. , does hereby further grant unto the City of Ames, Iowa, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use: (a) storm sewer over, upon, across and under a strip of land ten feet wide centered on and running the length of the common boundary be- tween Lots 10 and 11 and a strip of land ten feet wide centered on and running the length of the -common boundary between Lots 1 and 2, in Oakwood First Addition to the City of Ames, Iowa, as shown on the final plat thereof. (b) sanitary sewer over, upon, across and under the North ten feet of Lot 3. and a strip of land ten feet wide centered on and running the length of the common boundary between Lots 13 and 14 in Oakwood First Addition to the City of Ames, Iowa, as shown on the final plat thereof. (c) water mains over, upon, across and under a strip of land ten feet wide centered on and running the length of the common boundary be- tween Lots 11 and 12 and a strip of land ten feet wide centered on and running the length of the common boundary between Lots 2 and 3 in Oak- wood First Addition to the City of Ames, Iowa, as shown on the final plat thereof. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume.,responsibility for all, damage to the above described property caused by the City's exercise of its granted right.
