I see in the 2017 aerial that it was built already so we would be coming up on 4 years in the ground so I am leaning toward not requiring the 4 year maintenance security Since it has taken them SO LONG to get their as-builts correct and approved. Per our City Code, before we can release that security, stormwater management system as-built plans need to be submitted, reviewed, and approved. We will also need a cost estimate for 4 years of maintenance of the entire stormwater system, which will also need to be reviewed and approved. Eric Cowles just brought the LOCs with a post-it note on them on what they were for. He told me that he worked with Jake Moore and Planning. According to Jake, Wal-Mart's engineer had given Eric an estimate on what it would cost to install the 5B requirements. Eric just estimated the sidewalk himself. I have been in contact with Eric Cowles, who has been working with you on the construction-related items for the new North Ames Wal-Mart. I brought to his attention that if the public improvements, for which I have received security from Wal-Mart, have not been completed, the LOCs needed to be renewed for an additional time period. I raised this issue again with Eric last Thursday as the time of expiration for the existing two LOCs was drawing near. Eric brought me a print-out indicating that the expiration date of the two LOCs was now March 22, 2018. The City Attorney will not accept the print-out as proof of extension since the LOCs specifically show he expiration dates occurring March 21 and 22, 2017, respectively. Not sure how you want to handle the 4 year maintenance security since the project has been complete for several years and vegetation is established.
