Friedrich & Sons, Inc. ; and Buck Construction Company, Inc. , of Ames, Story County, Iowa, in consideration of the sum of One Dollar, receipt of which is hereby acknowledged, do hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use its electric lines, consisting of poles, wires, overhead or underground cables, fixtures, anchors and other similar equipment, or any part thereof, upon underground, over or across the following described real estate: The North 5 feet of Lots 7, 8, and 9. The Northerly 10 feet of Lots 14 , 15, 16, 20, 21, 23 , and 24 . The Northeasterly 10 feet of Lots 16, 17, 19, 21, 25, 26, 27, 28, and 29 . The Northeasterly 5 feet of Lots 1, 2 , 3 , 4 , 5, 6, and 22 . The Northwesterly 5 feet of Lots 3 , and 26. The Southerly 10 feet of Lots 7, 8, 10, and 17 . The Southerly 5 feet of Lots 24 and 25. The Southeasterly 10 feet of Lots 1, 9, 12 , 18, and 29 . The Southeasterly 5 feet of Lots 4 and 25. The Southwesterly 10 feet of Lots 1, 2, 3 , 4 , 5, 6, 9, 11, 22 , and 23 . The Southwesterly 5 feet of Lots 26, 27, 28, and 29 . The Easterly 10 feet of Lots 10 and 13 . -2- The Southeasterly 5 feet of the Northeasterly 5 feet of Lot 23 , and All of Lots "E" and "F" , all within the Second Addition, Northridge Parkway Subdivision to Ames, Iowa. We further grant to the City of Ames, Iowa, the right to permit other utility companies to construct and, in the same manner, maintain its utility facilities, jointly or severally, upon, underground, over or across the real estate as described above. We further grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use its underground storm sewer system within the following described real estate: A Ten (10) foot wide easement across part of Lot Twenty- one (21) ; Five (5) feet on each side of the following described centerline: Commencing at the Northeast (NE) corner of Lot Twenty- one (21) ; thence Southeasterly, along a 1, 050 foot radius curve, concave southwesterly, an arc distance of 85. 70 feet (the long chord bears S 220 03 ' 04" E, 85. 67 feet) , to the Point of Beginning; thence S 230 35 ' 54" W, 19. 66 feet to the Point of Ending, all within the Second Addition, Northridge Parkway Subdivision to Ames, Iowa. We do further grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to use the following described real estate as a greenbelt, walkway and flood plain: The Southwesterly 75 feet of Lots 13 , 14, 18, 19, and 20, -3- all within the Second Addition, Northridge Parkway Subdivision to Ames, Iowa. The foregoing rights are granted upon the express condition that the users of the granted rights will assume liability for all damage to the hereinbefore described real estate and adjoining real estate caused by failure to use due care in the exercise of the granted rights.
