We, Erben A. Hunziker and Margaret H. Hunziker, husband and
wife; Donald M. Furman and Ruth W. Furman, husband and wife; R.
Friedrich & Sons, Inc. ; and Buck construction Company, Inc. , of
Ames, Story County, Iowa, in consideration of the sum of One
Dollar, receipt of which is hereby acknowledged, do hereby grant
to the City of Ames, Iowa, a municipal corporation, its successors
and assigns, the perpetual right to construct, reconstruct,
maintain and use its electric lines, consisting of poles, wires,
overhead or underground cables, fixtures, anchors and other similar
equipment, or any part thereof, upon underground, over or across
the following-described real estate:
The North 10 feet of Lots 1, 10, 11, 12 , 27, 28, 29, and
30;
The Northerly 10 feet of Lots 2 and 21; IftT MO 0

all within the First Addition, Northridge Parkway Subdivision to
Ames, Iowa. We further grant to the City of Ames, Iowa, the right
to permit other utility companies to construct and, in the same
manner, maintain its utility facilities, jointly or severally,
upon, underground, over or across the real estate as described
above.
We further grant to the City of Ames, Iowa, a municipal
corporation, its successors and assigns, the perpetual right to
construct, reconstruct, maintain and use its underground storm
sewer system within the following described real estate:
The Southwesterly 5 feet of Lot 3 ;
The Northeasterly 5 feet of Lot 4 ;
The South 10 feet of the East 10 feet of Lot 18 ;
The North 10 feet of the East 10 feet of Lots 21 and 29 ;
The Northeasterly 10 feet of Lot 25;
All of Lots A and B,
all within the First Addition, Northridge Parkway Subdivision to
Ames, Iowa.
We do further grant to the City of Ames, Iowa, a municipal
corporation, its successors and assigns, the perpetual right to use

the following-described real estate as a greenbelt, walkway and
flood plain:
The West 75 feet of Lots 19 and 20;
The Southwesterly 75 feet of Lots 23 and 24 ,
all within the First Addition, Northridge Parkway Subdivision to
Ames, Iowa.
We do further grant to the City of Ames, Iowa, a municipal
corporation, its successors and assigns, the perpetual right to use
the following real estate as a bike path:
The East 20 feet of Lot 1 (no fences allowed) ,
and
The East 5 feet of the North 108 . 08 feet and the East 25
feet of the South 107 . 52 feet of the North 215. 26 feet
of Lot A (no fences allowed) ,
all within the First Addition, Northridge Parkway Subdivision to
Ames, Iowa.
The undersigned further reaffirm the location of the
Electrical Transmission Line dated November 20, 1965, recorded in
Book 101, page 389, and since revised and rerecorded on October 17 ,
1988 , in Book 272, page 129, as the Electrical Transmission Line
traverses real estate within the First Addition, Northridge Parkway
Subdivision to Ames, Iowa, as follows:
The South 33 feet of Lots 24 , 25, 26, 27 , 28 , 29, 30, and
the South 33 feet of Lots B and D.
The foregoing rights are granted upon the express condition
that the users of the granted rights will assume liability for all
damage to the hereinbefore described real estate and adjoining real

estate caused by failure to use due care in the exercise of the
