Krauth, hereby state that I am an Attorney at Law, duly admitted to the practice of law in the State of Iowa, and a member of the firm of Newbrough, Johnston, Brewer, Maddux & Krauth, L.L.P., with offices at 612 Kellogg Avenue, Ames, Story County, Iowa. I further state that I have examined the Abstract of Title to the following-described real estate, to-wit: Parcel A in the Northeast Quarter (NEI) of the Southeast Quarter (SEI) of Section Twenty-seven (27), Township Eighty-four (84) North, Range Twenty-four (24) West of the 5th P.M., in the City of Ames, Story County, Iowa, as shown on the 'Plat of Survey" filed in the office of the Recorder of Story County, Iowa, on February 8, 1995, and recorded as Instrument No. 95-01002 in C & F N Book 13, page 15, from the root of the title thereof, down to and including the 0-7 day of 1997, at _ o'clock :m., last certified by Cyclone Abstract & Title Company, Ames, Iowa (Iowa Title Guaranty Division Member #8195). The real estate has now been subdivided and is now known as NORTHERN LIGHTS SUBDIVISION, STORY COUNTY, IOWA. Based upon information within said Abstract of Title, it is my opinion that the fee simple title to said real estate is in GRAND INVESTORS, L.L.C. The real estate is free from encumbrances excepting, however, a Mortgage to First National Bank, Ames, Iowa, dated February 11, 1997, and filed in the office of the Recorder of Story County, Iowa, on February 21, 1997, as Instrument No. 97-01670. A portion of the property is also subject to restrictive covenants dated March 15, 1982, filed in the office of the Recorder of Story County, Iowa, on May 5, 1982, in Book 182 at page 61. The property is also subject he City of Ames on which was adopted b t to a resolution designating impermissible uses p y ty g g P n 26 1982 and filed in the office of the Recorder of Story County, Iowa, on January ry tY, June 10, 1982, in Book 182 at page 329. The property is further subject to easements and restrictions of record and to zoning ordinances of the City of Ames, Iowa. Dated this day of , 1997.
