Ladies and Gentlemen:
TITLE OPINION
I have examined the Abstract of Title to the subject property legally described as:
Beginning at the Northwest (NW) Corner of Lot Four (4), Block Forty-nine
(49), Fourth Addition to Ames, Iowa, thence South along the West line of
said Lot Four (4), a distance of Eighty (80) Feet, thence East Seventy (70)
Feet, thence North to the North line of said Lot Four (4), thence
Southwesterly along the Northerly line of said Lot Four (4) to the point of
beginning; and Lot Five (5), except the South One Hundred Twenty-five
(125) Feet thereof, in Block Forty-nine (49), Fourth Addition to the City of
Ames, Iowa,
certified by Sandy Fitzgerald of Batman-Sayers Abstract Company, Abstract No. 31637A,
containing a total of 25 entries last certified at 8:00 o'clock A.M., May 11, 2000.
TITLE
I have found record title to the above-described real estate (hereinafter called the
property) to be in Heartland Investments, an Iowa general partnership, by virtue of a Quit
Claim Deed dated July 14, 1995, and recorded in the office of the Story County Recorder
as Instrument No. 95-05890 on July 17, 1995.
The title to this property is subject to the following exceptions and also subject to
the Standard Exceptions shown on Schedule A attached hereto.

EXCEPTIONS
The last unnumbered entry of the Abstract shows that the Regular Taxes for Fiscal
1998-99 were paid in full March 30, 2000.
Entry 24 of the Abstract shows that pursuant to Ordinance No. 2751 passed June
3, 1980 and filed in the office of the Story County Recorder in Book 164, Page 222, on
June 23, 1980, the property is Zoned "C-C" (Concentrated Commercial).
LIMITATION OF USE OF TITLE OPINION
This opinion is rendered solely for the benefit of the addressee or addressees named
herein. No other persons shall be entitled to rely upon the contents of this opinion or the
conclusions expressed herein without the prior written consent of the undersigned
examining attorney.
PROPOSAL FOR SUBDIVISION
Enclosed is a copy of a proposed Final Plat, Nelson Subdivision, Ames, Iowa.
Upon approval and filing of this Final Plat the property would then have the following
legal description:
Lot 1, Nelson Subdivision, Ames, Iowa.
Heartland Investments, an Iowa general partnership, is the fee title owner of the
property which has no encumbrances.

SCHEDULE A--STANDARD EXCEPTIONS
1. The abstract does not show rights of access to and from the Real Estate.
2. Rights or claims of parties in possession are not shown in the abstract.
3. You should ascertain that no improvements either in the form of labor or
materials, which have been placed on the premises in the last ninety days, still remain
unpaid, as they would constitute liens without being shown of record.
4. The abstract does not disclose the existence of environmental deficiencies
such as underground storage tanks, wells, solid waste, hazardous wastes, asbestos, or radon
gas. Liability for removal and remediation may be imposed by virtue of ownership of the
Real Estate even though one may riot have been responsible for the deficiency.
5. Easements, or claims of easements, existing by virtue of usage, or which do
not otherwise appear in the abstract.
6. The abstract does not show if there are any encroachments, overlaps,
boundary lines, and any other matters which would be disclosed by an accurate survey and
inspection of the Real Estate.
7. The abstract does not show the location of all public utility lines that service
the property and the necessary easements therefor.
8. Any other matter affecting the real estate which may have been filed as a
part of the public records in the county courthouse after the period of time covered by this
Title Opinion.
