GENERAL UTILITY
RIGHT-OF-WAY PERMIT AND EASEMENT
Iowa State University Research Foundation, Inc. , a
non-profit corporation
The undersigned,/ Erben A. Hunziker and Margaret H. Hunziker, husband
and wife, of Ames, Story county, Iowa, in consideration of the sum of One
dollar ($1.00) the receipt of which is hereby acknowledged, do hereby grant to
the City of Ames, Iowa, a municipal corporation, its successors and assigns, a
perpetual right to construct, reconstruct, maintain and use its electric lines,
consisting of poles, wires, overhead and underground cable, fixtures, anchors
and other similar equipment or any part thereof, for the sole purpose of
general utility use and for conveying electric current for power and light
purposes, telephone cable, gas lines and drainage together with the right to go
upon the premises, make repairs, install lines and to extend to any telephone,
electric, power or cable company the right to use jointly with grantee, any
pole placed pursuant to the provisions thereof together with the right to trim
any trees to allow for clearance of at least four (4) feet where necessary to
secure adequate clearance for the safe operation of electric lines upon,
underground or adjacent to that real estate located in Mission Ridge
Subdivision, Ames, Iowa, and more specifically described as:

Twenty (20) feet on each side of the following described
centerline:
"Commencing at the most Northerly corner of Lot Twelve
(12) ; thence Northwesterly, along a 430 .00 foot radius
curve, concave northeasterly, an arc distance of 169.43
feet (the long chord bears N 34°33' 06" W, 168.34 feet), to
the Point of Beginning; thence S 77000' 00" W, 101.30 feet
to the Point of Ending. " Note : This easement is a
redefinition of and is a wholly contained existing
easement , which was platted within The Gateway Hills
Subdivision; and recorded in Book 147 , Pages 275--276 , on
December 29, 1978.
The foregoing right is granted upon the express condition that the
ity of Ames will assume liability for all damage to the herein described
property caused by the City's failure to sue due care in its exercise of the
ranted right.
