IIAPPEL September 24 , 1999 MECA, L.L.C. % Ev Cochrane & Associates, Inc . 207 Stanton Ames, IA 50014 Dear Mr. Cochrane : At your request I have examined the abstract of title to the following described real estate, to-wit : A Replat of Parcel "A" in Lot Thirteen (13) , Block One (1) , Beardshear' s Addition, as shown on the "Plat of Survey" filed in the office of the Recorder of Story County, Iowa, on December 23 , 1998, and recorded as Instrument #98-17892 on Slide 12 at Page 4 ; AND Lot Fourteen (14) Block One (1) , Beardshear' s Addition, except the South Seven and Five Tenths (7 . 5) feet thereof; AND all that part of the West Fifteen (15) feet of Lot Sixteen (16) , in Parker' s Addition, lying South of the south line extended of said Lot 13 ; all . in the City of Ames, Story County, Iowa; as continued from the Original Government Entry, - down to and including the 29th day of July, 1998 , at 3 :20 P.M. , as last certified to by Abstract and Title Services of Story County. From this abstract I find that as of the date last mentioned, merchantable title to said real estate was vested in MECA, L.L.C. , a limited liability company, subject to the following comments and objections : None . CAUTION Since the following cannot be determined by examination of the abstract, your cttention is called to the fact that you are required to take notice of the rights of all persons in possession 9 14071 r . September 24, 1999 Page 2 of the real estate other than the titleholders of record; any facts that would be disclosed by a survey; the right to file mechanic ' s liens against the premises for labor or materials furnished in connection with improvements thereon, within ninety days from the furnishing of the last item; and any restrictions as to building, occupancy, or usage contained in applicable zoning or other city ordinances . In addition, you should determine whether any solid wastes, hazardous substances, pollutants, above or below ground storage tanks, drainage wells, water wells, landfill sites or other environmentally regulated conditions exist on the property. Such conditions are not ordinarily shown in the abstract, but they may result in injunctions, fines, required cleanup, or other remedial actions under federal , state or local laws . These laws may impose liens against the property and personal liability .against the owner, even though the owner did nothing to create the condition, and acquired the property without knowing about it .
