RESOLUTION NO. 14-645
RESOLUTION PROPOSING VACATION OF A PUBLIC UTILITY
EASEMENT AND A DRIVE EASEMENT LOCATED IN WESTWOOD
VILLAGE SUBDIVISION AT 145 MARSHALL AVENUE IN AMES,
IOWA; SETTING DATE, TIME AND PLACE OF PUBLIC HEARING
THEREON AND DIRECTING PUBLICATION OF NOTICE
WHEREAS, the Property Owner of 145 Marshall Avenue recently added a new
apartment building to Lot 6 in Westwood Village Subdivision; and
WHEREAS, it is determined that a public utility easement and a drive easement on the
property are no longer needed due to the ownership and configuration of the new building; and
WHEREAS, pursuant to Iowa Code section 364.12, the City Council has the authority,
following notice and hearing, to vacate easements.
THEREFORE,BE IT RESOLVED by the City Council for the City of Ames, Iowa:
A public hearing on the proposed vacation of a public utility easement and drive
easement as aforesaid shall be held as required by law to coincide with the City Council meeting
of January 13, 2015, which will begin at 7:00 p.m. in the Ames City Hall, 515 Clark Avenue,
Ames, Iowa.
BE IT FURTHER RESOLVED that the City Clerk is directed to provide notice
pursuant to Iowa Code section 362.3.
ADOPTED THIS 16t'day of December, 2014.
