That Iowa State University Research Park, having its
principal place of business at Ames, Story County, Iowa, a
corporation organized and existing under the laws of the State of
Iowa, for good and valuable consideration, receipt of which is
hereby acknowledged, does hereby grant unto the City of Ames ,
Iowa, a municipal corporation, its successors and assigns , the
perpetual right to construct, reconstruct, maintain and use
utility services and apparatus upon, underground, over or across
the following-described real estate, all of said real estate

The undersigned does further hereby grant unto the City
of Ames , Iowa, its successors and assigns , a 20-foot wide
landscaping easement adjoining all street tights-of-way within
said subdivision.
The undersigned does further hereby grant unto the City
of Ames , Iowa, its successors and assigns , an unobstructed
easement for the construction and maintenance of ditches and
slopes for conducting surface drainage over the westerly 10 feet
of Lot 3 adjoining the easterly line of Elwood Drive.
The foregoing rights are granted upon the express
condition that the users of the granted rights will assume
liability for all damage to the real estate described herein and
any adjacent real estate caused by the failure to use due care in
the exercise of the granted rights.
