IOWA STATE UNIVERSITY RESEARCH PARK CORPORATION
WHEREAS, Iowa State University Research Park Corporation has
applied to the City of Ames for a building permit for the "Multi
tenant" facility which appear in the Layout Plan, Landscape Plan
and Utility Plan which are attached as Exhibits A-1 and A-6 .
WHEREAS, the Ames Municipal Code at Section 29 . 24 ( 3) (d)
requires the developer to meet certain minimum standards for
plant materials "including [a] bond or cash escrow to guarantee
satisfactory performance of the provisions of the site and
landscape plans in a sum established by the City Manager. " See
attached Exhibit B-1 through B-3 (emphasis added) for the full
code section.
-- -WHEREAS-,, the City Manager _of_ Ames has determined. the project
described in Exhibit A requires a bond in the amount of Two
Hundred Five Thousand Dollars ( $205,000 . 00) , to satisfy Ames
Municipal Code Section 29 . 24 ( 3) (d) .
WHEREAS, Iowa State University Foundation, the controlling
entity of Iowa State University Research Park Corporation, and
lender for the project described in Exhibit A and Iowa State
University Research Park Corporation agrees to be jointly held
and firmly bound unto the City of Ames, Iowa, for the sum of the
bond described above_ in the event the site and landscaping
improvements shown on A-1 through A-6 are not completed to the
satisfaction of City.
NOW, THEREFORE, this obligation becomes effective upon
signature and remains in full force and effect until the
requirements of Ames Municipal Code Section 29 . 24 ( 3) (d) are
satisfied. Upon request, the City of Ames, will indicate
satisfaction of this code section, in writing, by its City
Manager.
