That Iowa State University Research Foundation, Inc. , a
nonprofit corporation organized and existing under the laws of
the State of Iowa, with its principal place of business at Ames,
Story County, Iowa, for good and valuable consideration, receipt
of which is hereby acknowledged, does hereby grant unto the City
-IN of Ames, Iowa, a municipal corporation, its successors and
assigns, the perpetual right to construct, reconstruct, maintain
and use utility services and apparatus upon, underground, over or
across the following-described real estate, all of said real
estate being situated within Ironwood Estates Subdivision, Ames,
Iowa, a replat of Lot Fourteen ( 14) and part of Lot One ( 1 ) ,
Gateway Hills II, Ames , Iowa:
Lot 1 : "Beginning at the N.E. Corner of Lot One ( 1 ) ;

Northwesterly, along a 173 . 71 Foot radius curve,
concave Northeasterly, an arc distance of 29 . 88 Feet

beginning. "

This instrument is to ratify and confirm the easements
above-described, which were also set forth in an instrument
granting said easements to the City of Ames, Iowa, filed in the
office of the Recorder of Story County, Iowa, in Book 209,
page 166 .
The undersigned does further hereby grant unto the City
of Ames, Iowa, its successors and assigns, a general utility
easement upon, underground, over or across the
following-described real estate:
The North 5 Feet of Lot Eight ( 8 ) , Ironwood
Estates Subdivision, Ames, Iowa, a Replat of Lot
Fourteen ( 14) and part of Lot One ( 1 ) , Gateway
Hills II, Ames, Iowa.
The undersigned does further grant to the City of Ames,
Iowa, the right to permit other utility companies to construct
and, in the same manner., maintain their utility facilities,
jointly or severally, upon, underground, over or across the real
estate described above.
The foregoing rights are granted upon the express
condition that the users of the granted rights will assume
liability for all damage to the real estate described herein and
any adjacent real estate caused by failure to use due care in the
exercise of the granted rights.

personally appeared Richard F. Ross and Daniel L. Griffen, Jr . ,

they are the President and Secretary, respectively, of said
corporation executing the within and foregoing instrument; that

said instrument was signed and sealed on behalf of said
corporation by authority of its Board of Directors; and that the

voluntarily .executed.
