Dear Sirs:
Pursuant to the requirements of Iowa a Code Section 354.11(3) (1999), I hereby certify that
I have examined the abstract of title last continued in pencil note form by Batman-Sayers Abstract
Company,No. 30876A, showing a continuation of entries from Root of Title to September 27, 1999
at 8:00 a.m., relating to the following described real property:
Commencing at the Southwest Corner of Section One (1), Township Eight-three
(83) North, Range Twenty-four (24) West of the 5t" P.M., Story County, Iowa,
thence North along the West Line of the Southwest Quarter(SW1/4) of Section One
(1), a distance of Seventy-five (75) feet, thence South 88' 21' 20" East along the
North Right-of-Way line a distance of Six Hundred (600) feet, thence South 89' 34'
15" East along said Right-of-Way line a distance of Two Hundred Sixty-One and
Thirty-Three Hundredths (261.33) feet to the point of beginning, thence North
Eighty-Eight and Thirty-Nine Hundredths(88.39)feet, thence North 14°44'40" East
Three Hundred Thirty-Five and Four-tenths (335.4) feet, thence North 22' 43' 40"
East One Hundred Seventy-Four and Twelve Hundredths (174.12) feet, thence
South 89°21'10" East Six Hundred Twenty-Eight and Twenty-Six Hundredths
(628.26) feet to a point on the Centerline of the Skunk River, thence South 28' 15'
West along the Centerline of the Skunk River, Six Hundred Thirty-Six and Ten

distance of Thirty-Three and One-Tenths (33.1) feet, thence North 89' 43' 15" West
along said Right-of-Way a distance of Four Hundred Forty-Seven and Ninety-Eight
Hundredths (447.98) feet to the point of beginning. Said tract containing 7.51
Acres.
To be hereafter known as Lot 1, Iowa State Ready-Mix Subdivision, an Official Plat,
now included in and forming a part of the City of Ames, Story County, Iowa.

As of the last date and time, record title to the property above described is vested of record
in:
Iowa State Ready-Mix Concrete, Inc., an Iowa corporation
subject to the following:
1. MORTGAGES: None shown.
2. CONTRACT: The Abstract shows a Contract between the City of Ames and a
prior titleholder providing for an easement across property owned by the City of Ames and as
consideration therefore an agreement binding upon the owners of the subject property not to
construct any bridges or erections of any type without the approval of the City. This Contract is
dated February 5, 1945 and filed of record February 7, 1945, at Book 60,Page 623.
3. EASEMENTS: None shown.
4. ZONING: The property under examination is subject to the zoning ordinances of
the City of Ames, Iowa.
5. TAXES: The Abstract shows the taxes on the subject property as paid through the
first half of fiscal year 1998-99. Second installment taxes are shown at $3,996.00 and due but not
delinquent. These taxes are assessed in 0-9481,P-09-01-350-090.
6. SEARCHES: The last Abstract update shows searches as to the above titleholder
and its predecessors in interest.
You are hereby advised that this opinion is prepared pursuant to Iowa Code Sections 614.26
and 614.28 of the 1999 Code of Iowa, Chapter 11 of the Iowa Title Examination Standards, the
abstracting standards of the Iowa Land Title Association and the 40 Year Marketable Title Act.
