HomeMy WebLinkAbout~Master - Vacation of public utility easement at 2810-2824 Wakefield Circle DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Judy K.Parks,City Attorney,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 14-545 RESOLUTION APPROVING VACATION OF PUBLIC UTILITY EASEMENT FOR 2810 - 2824 WAKEFIELD CIRCLE FOR THE CITY OF AMES,IOWA WHEREAS, staff was contacted by the property owner of 2810 and 2824 Wakefield Circle in the Ames Community Development Park about developing those two properties as a single development; and, WHEREAS,the properties currently have a 10-foot public utility easement along the property line between them; and, WHEREAS, the property owner requested that the easement be vacated to accommodate development as one parcel; and, WHEREAS,pursuant to Iowa Code Section 364.7,notice was given on September 23, 2014, and a public hearing is being held regarding the proposal of the City to vacate the easement; and, WHEREAS, vacation of the easement is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA THAT: 1. Pursuant to Iowa Code Section 364.7,publication of notice regarding the proposed vacation of the public utility easement and establishing a public hearing date regarding the proposal has been made. 2. The public hearing regarding the disposition of the property is hereby closed. 3. The easement across the following described land is hereby vacated: The east 5 feet of Lot 8, Ames Community Development Park, 4lb Addition, excluding the north 10 feet and the south 5 feet; AND, The west 5 feet of Lot 13, Ames Community Development Park, 41h Addition, excluding the north 10 feet and the south 5 feet.
