DEFINITIONS. When used in this instrument, unless otherwise required by the context: (a) "Grantor" means Horne-Ames, LLC, a Tennessee Limited Liability Com- pany- (b) "Easement Area" means the tract of land described on Exhibit "A", at- tached hereto. (c) "Benefited Property" means the real property described as follows: Lots 2 and 3, Horne Subdivision, Ames, Iowa. 2. EASEMENT CREATED. The Grantor hereby grants to those persons having any right, title or interest in the Benefited Property the perpetual right to use the Ease- ment Area for purposes of ingress to and egress from the Benefited Property. 3. EASEMENT APPURTENANT. The easement rights granted under this in- strument shall be appurtenant to Lots 1, 2, and 3 of Horne Subdivision, Ames, Iowa. 4. NONEXCLUSIVE EASEMENT. The easement rights granted under this in- strument are nonexclusive. This instrument shall not preclude Grantor from granting similar easement rights to third parties upon terms and conditions that do not impair or diminish the rights granted under this instrument for the Benefited Property. 5. SUCCESSORS BOUND. This instrument shall be binding upon and inure to the benefit of the respective successors and assigns of the Grantor and the owners of the Benefited Property. 6. CONSTRUCTION. Words and phrases used in this instrument shall be con- strued as in the single or plural number, and as masculine, feminine or neuter gender, horp.007 - 2 - according to the context. This instrument shall be governed exclusively by and construed in accordance with the laws of the State of Iowa. The paragraph headings in this instru- ment are for convenience only and in no way define or limit the scope or intent of any provisions of this instrument. This instrument may be executed in any number of coun- terparts, each of which shall be regarded as an original and all of which shall constitute but one and the same instrument.
