INSTRUMENT PREPARED BY: David W.Benson,P.O.BOX 270,Ames IA 50010(Te1:515-239-5000) + c., n 6 LENDER'S CONSENT TO PLATTING WHEREAS, FIRST AMERICAN NATIONAL BANK, a national banking asso- ciation (the "Lender") is the present owner of (1) the mortgage given by Horne-Ames, LLC to the Lender under date of June 17, 1997, and filed in the office of the Recorder of Story County, Iowa, on June 20, 1997, and recorded as Instrument No. 97-06211; and (2) the assignment of rents and leases , given by Horne-Ames, LLC to the Lender under date of June 17, 1997, and filed in the office of the Recorder of Story County, Iowa, on June 20, 1997, and recorded as Instrument No. 97-06212; and (3) the financing statement given by Horne-Ames, LLC to the Lender and filed in the office of the Recorder of Story County, Iowa, on June 20, 1997, and recorded as Instrument No. 97-06213; and WHEREAS the mortgage, the assignment of rents and leases, and the financing statement grants to the Lender an interest in the real property described as follows: Parcel "E" in the Southwest Quarter of Section 14, Township 83 North, Range 24 West of the 5th P.M., in the City of Ames, Story County, Iowa, as shown on the "Plat of Survey" filed in the office of the.Recorder of Story County, Iowa, on the 27th day of May, 1997, and recorded as in- strument#97-05150 in Book 14 at Page 210. and WHEREAS, the Lender has been requested to consent to the platting of the real property which shall thereafter be known as Horne Subdivision, Ames,Iowa, and deems it advisable to do so: NOW, THEREFORE, for good and valuable consideration, the Lender states that the plat of the real property to be known as Horne Subdivision, Ames, Iowa is prepared with the Lender's free consent and in accordance with the Lender's desire. The Lender further agrees that whatever right, title, lien, estate and interest the Lender now has or may hereafter acquire in said real estate by virtue of the mortgage, assignment of rents and leases, and the financing statement, the same shall be junior, inferior and subordinate horp.004 q-1- 136 i0 C r - 2 - to the Utility Easement dated December , 1997, on said real property granted by Horne-Ames, LLC to the City of Ames, Iowa.
