COUNCIL ACTION FORM
SUBJECT: APPROVE VACATING A PORTION OF THE STORM SEWER, SURFACE
WATER FLOWAGE, AND THE PUBLIC PATHWAY EASEMENT AT 504 POE
CIRCLE.
BACKGROUND:
A Storm Sewer and Surface Water Flowage Easement was granted to the City with the
Final Plat of Hillside Subdivision, 4th Addition for the westerly 15' of Lot 16 (504 Poe
Circle). A Public Pathway Easement was also granted over the same area. The property
owner at 504 Poe Circle requested that staff review the width required for the
easements and consider vacating any portion that is not necessary. The storm sewer
and the 4' pathway are nearly centered on the property line and would not necessitate
use of the full easement width for maintenance. The area was graded so that during a
major storm, ponding would occur within the right-of-way on Poe Circle and any
overflow would be concentrated on the pathway. Considering these factors, the easterly
5' of the easements on Lot 16 could be vacated. The entire 15' easement is not
necessary based on the existing site grading.
ALTERNATIVES:
1. Approve vacating a portion of the storm sewer, surface water flowage, and the
public pathway easement at 504 Poe Circle that is the easterly 5'.
2. Retain easements as granted.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1,
thereby approving the vacation of a portion of the storm sewer, surface water flowage,
and the public pathway easement at 504 Poe Circle that is the easterly 5'.
