RESOLUTION NO. 14-451
RESOLUTION APPROVING VACATION OF PUBLIC UTILITY EASEMENT FOR
4540 MORTENSEN ROAD
FOR THE CITY OF AMES,IOWA
WHEREAS,there is an existing public utility easement currently running through of the property
located at 4540 Mortensen Road; and,
WHEREAS,the property owner made a request to vacate the public utility easement in order to
move forward with development of the site; and,
WHEREAS,pursuant to Iowa Code Section 364.7,notice was given on July 22,2014,and a public
hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7,publication of notice regarding the proposed vacation
of the public utility easement and establishing a public hearing date regarding the proposal has been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The easement across the following described land is hereby vacated:
A part of Lot 2 of 8th Addition,Dauntless Subdivision,Ames,Iowa,being 5 feet on
each side of the following described centerline: Commencing at the SW corner of
said Lot 2; thence Northeasterly along the West line of said Lot 2 and a curve
concave Southeasterly whose radius is 2,467.18 feet,whose arc length is 120.61 feet
and whose chord bears North 08°23'36" East, 120.60 feet; thence South 81°39'16"
East, 10 feet to the point of beginning; thence continuing South 81°39'16" East,
147.49 feet; thence North 08°20'44" East, 69.31 feet and the point of terminus.
ADOPTED THIS 12th day of August, 2014.
