Re: Request for Abandonment of Utility Easements
Dear Mayor Curtis and Council Members:
The attached letter from Engineering Plus requests the abandonment of the
listed utility easements by council resolution. I have prepared the attached
resolution. I have checked with the Department of Public Works and Planning
and Housing and there was no objection to the request.

Dear John:
The purpose of this letter is to request abandonment of various utility easements
within the subject property. This is being requested to allow Manatt's Inc. to
develop maintenance facilities over the existing (platted) easements.
The specific easements to be abandoned are described as follows:
1 . The South 5-feet of Lot 3.
2. The West 5-feet of the South 85-feet of Lot 3.
3. The West 20-feet of the North 20-feet of the South 315-feet of Lot 3.
4. The South 5-feet of the North 425-feet of the East 180-feet of Lot 2.
5. The West 5-feet of the East 185-feet of the South 90-feet of the North 425-
feet of Lot 2.
Those easements are as shown on the enclosed "Final Plat of Hilgenberg 2nd
Subdivision" dated February, 1978. 1 have also enclosed a site plan of the facilities
proposed by Manatts on those lots. There is an existing fire hydrant in number 3
above, which will be relocated to an area within another existing utility easement.
No other services exist within the easements to be abandoned.

Bob Goodwin is the attorney for Manatts, and he has indicated that a simple
Resolution of Abandonment from City Council is preferable to a quit claim deed for
these abandonments. Please let me know if you need any additional information to
process this request. Thank you.

John Klaus, City Attorney, asked that I send you follow-up
correspondence regarding your request to abandon various utility
easements on East 13th Street. This request was addressed by the City
Council at their meeting on April 12, 1994,. and they passed Resolution No.
94-142 abandoning the unneeded easements. I have enclosed a copy of
this resolution for your records.
