ATTORNEY' S OPINION
I, Frank B. Johnston, hereby state that I am an Attorney
at Law, duly admitted to the practice of law in the State of Iowa,
and a member of the firm of Newbrough, Johnston, Brewer, Maddux &
Nadler, with offices at 612 Kellogg Avenue, Ames, Story County,
Iowa. I further state that I have examined the Abstract of Title
to the following-described real estate, to-wit:
The West 190 Feet of the East 412 . 5 Feet of the SE 1/4
of the SW 1/4 , EXCEPT the South 563 Feet thereof; AND
the East 222 . 5 Feet of the SE 1/4 of the SW 1/4, EXCEPT
the South 63 Feet thereof, and EXCEPT the West 122 .5 Feet
of the North 140 Feet of the South 203 Feet thereof; AND
(a replat of) Lot Four (4) , Skunk River East, First
Industrial Addition; all in the SE 1/4 of the SW 1/4 of
Section 1, Township 83 North, Range 24 West of the 5th
P.M. , in the City of Ames, Story County, Iowa; more
particularly described as follows:
Commencing at the Southeast Corner of the SW 1/4 of
Section 1, Township 83 North, Range 24 West of the 5th
P.M. , in the City of Ames, Story County, Iowa; thence

the SE 1/4 of the SW 1/4 of said Section 1 to the point
of beginning; thence continuing North 01013 ' 1011 East
1, 257 . 08 Feet along the East line of the said SE 1/4 of

the North line of said SE 1/4 of the SW 1/4 ; thence South

from the root of the title thereof, down to and including the
2.8- day of *December- , 1992 , last certified by Batman-
Sayers Abstract Co. , Nevada, Iowa. The real estate has been
subdivided and is now known as H & B SUBDIVISION TO AMES, IOWA.
Based upon information within said Abstract of Title, it
is my opinion that the fee simple title to said real estate is in
William K. Fedeler, Story Construction Co. , an Iowa Corporation,
and the City of Ames, Iowa, a Municipal Corporation, and that said
real estate is free from encumbrances excepting, however, a
Mortgage to First National Bank, Ames, Iowa, dated April 3 , 1989,
and filed in the office of the Recorder of Story County, Iowa, on
April 4 , 1989, in Book 362 at page 104 , and a Mortgage to First
National Bank, Ames, Iowa, dated April 2 , 1990, and filed in said
office of said county on April 3 , 1990, in Book 386 at page 275;
the property is subject to easements of record and to zoning
ordinances of the City of Ames, Iowa. t� (�
