municipal corporation, its successors and assigns, the perpetual
right to construct, reconstruct, maintain and use utility services
and apparatus for -the purpose of water mains underground, upon,
over or across those areas described on Exhibit "A" attached hereto
and made a part hereof and described as follows:

(identified on Exhibit ."A" as "D") .

The foregoing rights are granted upon the express
condition that the users of the granted rights will assume
liability for all damage to the real estate described herein and
