The Undersigned further grant unto the said City of Ames , Story County, Iowa, the perpetual right to construct, recon- struct, operate and maintain a storm sewer over the following described real estate , to-wit : As to Lot A ten feet either side of the following de- scribed line : Beginning at a point on the Easterly side of Lot A, which is S 29°47 ' 20" E , 105 feet from the Northwest corner of Lot 20 , The Green Third Addition; thence S 60012 ' 40" W, 115 feet, and five feet either side of the following described line : Beginning at a point on the Northeasterly .line of Lot 16 , .which is S 44°33 ' 40" E, 6 . 22 feet. from the most Southerly corner of Lot 15 ; thence N 81052130" E, 85 feet. As to Lot A five feet either side of the following de- scribed line : Beginning at a point which is 25 feet North and 5 feet East of the Southwest corner of Lot A; thence N 7059 ' 30" E , 102 . 3 feet, to a point which is 106 . 88 feet Northeasterly of the most Southerly corner of Lot 21. As to Lot 21 a strip of land 5 feet either side of the following described line : Beginning at a point on the South- westerly line of Lot 21 which is 106 . 88 feet Northwesterly of the most Southerly corner thereof; thence N 7°59 ' 30" E to a point on the South line of Pinehurst Drive which is 10 . 32 feet Northwesterly of the most Northeasterly corner of said Lot 21. All of the above property located in The Green Fifth Ad- dition to Ames , Iowa, and as shown on the plat of _said subdi- sion. The foregoing rights are granted upon the express condi- tion that the City of Ames will assume responsibility for all damage to the above described property caused by the City' s failure to use due care in the exercise of its granted right.
