RESOLUTION WAIVING POSTING REQUIREMENTS AND AUTHORIZING
REMOVAL OF STREET TREE AT 821 DUFF AVENUE
FOR THE CITY OF AMES,IOWA
WHEREAS, City staff was recently notified of the need to remove a red maple street tree at
821 Duff Avenue,and this is due to the need to replace an aged sanitary sewer service that will serve
a new Habitat for Humanity duplex at that location; and,
WHEREAS, staff explored various options to preserve this tree with the sewer contractor,
however, the depth of the sanitary sewer main and the location of utilities in the area make it
infeasible to provide sanitary service to this property without removing the tree; and,
WHEREAS, Chapter 27 of the Municipal Code requires that a street tree be posted for 15
days prior to it being removed, and allows for anyone to have a hearing before the City Council to
object to the removal; and,
WHEREAS,Habitat's contractor is ready to install the new sewer service immediately,and
a 15-plus day posting would delay the construction of this duplex; and,
WHEREAS, staff has found no viable options or alternatives that would allow for
preservation of this tree; and,
WHEREAS,having a replacement tree planted after construction could help offset the loss
of this maple, and Habitat for Humanity has indicated it would replant the tree if necessary on this
proj ect.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that waiver of the posting requirements of the Municipal Code is hereby approved, and removal of
the street tree at 821 Duff Avenue is hereby authorized.
ADOPTED THIS 17th day of June, 2014.
