HomeMy WebLinkAboutA002 - Council Action Form dated August 24, 1999 r 0 ITEM 91, 02'� • DATE 08/24/99 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING THE FINAL PLAT OF THE GRAND JUNCTION SUBDIVISION. ACTION FORM SUMMARY: The applicants, Grand Junction L.C. have requested that the City Council approve the Final Plat of Grand Junction Subdivision. Staff has reviewed this subdivision and is recommending that the plat be approved. BACKGROUND: Grand Junction, L.C. (Hubbell Realty) has requested that the City approve a one lot subdivision of property owned by Grand Junction L.C., which is located at the northeast corner of the intersection of Grand Avenue and Lincoln Way (the location of Hollywood Video, Carlos-O'Kelly's, and Bruegger's Bagels). Hubbell Realty is seeking a new zoning and building permit for an additional retail store, and the new subdivision regulations require that all property be included in an approved subdivision prior to the issuance of permits. ANALYSIS: The request for final plat approval is being processed as a single lot "Minor Subdivision" under the newly adopted subdivision regulations of the City. Prior to the processing of the minor subdivision, staff was in disagreement with the applicant regarding the appropriateness of using the minor subdivision process as a means to complete the subdivision of this property. The disagreement related to the requirement to dedicate right-of-way adjacent to the subject property for the purpose of lane widening for the contemplated intersection improvements at Grand Avenue and Lincoln Way. Ultimately, the staff and the property owner have been able to reach an acceptable solution for obtaining additional right-of-way for the anticipated lane widening. The applicant is proposing to grant the City a 10-foot easement that will enable the City to construct the needed additional lane width. This will give the City the needed property right, yet allow the property owner to maintain ownership of the land and thus remain in compliance with applicable zoning requirements. Additionally, the applicant is proposing to grant a 30-foot electrical easement for the existing electrical "tie-line" between the City Power Plant and the ISU Power Plant. This easement was to have been granted to the City some time ago, but the process was never completed. J a The City Council should understand that one of the basic purposes for the administration of subdivision regulations, which is provided for in Section 23.102(1)(c), is: (c) To encourage orderly development of the City and provide for the regulation and control of the extension of public improvements, public services and utilities, the improvement of land, and the design of subdivisions that are consistent with the City's Land Use Policy Plan and other specific community plans. The minor subdivision process provides for a shortened process for the property owner to obtain City Council approval of a subdivision of a small (3) number of lots. Additionally, the minor subdivision process enables the City to obtain easements, rights-of-way, and other limited improvements that would not otherwise occur under the typical administration of zoning regulations. In the case of the Grand Junction Subdivision, the applicant will obtain approval of the subdivision in a shorter time than if a major subdivision were to occur. Conversely, the City has been able to secure easements for electrical facilities and future road improvements that will create an orderly development of the land in this area of the city. Staff has reviewed the final plat of the Grand Junction Subdivision and recommends that the Final Plat be approved. ALTERNATIVES: 1. The City Council can approve the Final Plat of the Grand Junction Subdivision. 2. The City Council can approve the Final Plat of Grand Junction Subdivision with conditions. 3. The City Council can deny approval of the Final Plat of Grand Junction Subdivision. 4. The City Council can refer the Final Plat of Grand Junction Subdivision back to City staff for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative#1. This action will approve the Final Plat of Grand Junction Subdivision. As stated in the analysis section of this Action Form, the City Council needs to understand that part of the purpose for the administration of the subdivision regulations, for both minor subdivisions and major subdivisions, is to enable the City to determine the need for easements, rights-of-way, and other improvements. As a result of this purpose, there may be times when the property owner may be of the belief that the minor subdivision process is a simple and straight forward process, only to find that based on review, such requirements as easements or right-of-way may result.
