COUNCIL ACTION FORM
SUBJECT: SETTING A DATE OF PUBLIC HEARING TO CONSIDER
VACATING A SANITARY SEWER EASEMENT IN THE GRAND JUNCTION
SUBDIVISION.
ACTION FORM SUMMARY: The City has had an easement for sanitary sewer on
property recently subdivided as Grand Junction Subdivision. Part of the sanitary sewer
easement is in the wrong location.
Staff is recommending that the City Council vacate a portion of the sanitary sewer
easement that is incorrectly located.
BACKGROUND:
Sometime ago, the City worked with the then owner of the property that has been recently
subdivided as Grand Junction Subdivision to obtain a sanitary sewer easement. The sewer
easement, that was obtained sometime ago, was determined as a result of performing
locates of the sanitary sewer main. The easement document was prepared as a result of
this process, and the easement was given to the City.
More recently, as a result of actually excavating to determine the location of the sanitary
sewer, the current owner of the property has determined that the sewer is in a different
location than originally believed. As part of the recent Grand Junction Subdivision,
new easement documents have been prepared and accepted by the City that reflects
the accurate location of the sewer.
The current property owner is now requesting that the City vacate a portion of the former
easement that the City and the current owner no longer need. There is no need for the
portion of the easement that the landowner is requesting the City to vacate, therefore, the
staff is recommending that the portion of the easement that is described as Exhibit A to the
attached Resolution be vacated.
ALTERNATIVES:
1. The City Council can decide to vacate a portion of a sanitary sewer easement in the
Grand Junction Subdivision, and set September 14, 1999 as the date of public
hearing to receive comments on the vacation of this easement.
2. The City Council can decide not to vacate the portion of the sanitary sewer
easement, as requested.
3. The City Council can refer this issue back to staff for additional information.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This will approve the request to vacate a portion of a sanitary sewer easement in the Grand
Junction Subdivision, and set September 14, 1999 as the date of public hearing to receive
comments on the request to vacate the easement .
