STREET EASEMENT
KNOW ALL PERSONS BY THESE PRESENTS:
That Grand Junction L.C. and Brenton Bank, mortgagee,their successors and assigns,for good and
valuable consideration,receipt of which is hereby acknowledged, do hereby grant unto the CITY OF
AMES,IOWA,a municipal corporation,its successors and assigns,the permanent and perpetual right
to enter upon the land hereinafter described for purposes of a public street and public utilities and
construction and maintenance thereof over, across and under the land described as:
A strip of land 10 feet wide located across that part of Lot 1 of the Grand Junction
Subdivision of the SWl/4 of the SW'/4 of Section 2, T83N, R24W of the 5ffi P.M. in
the City of Ames, Story County, Iowa, more particularly described as follows:
Commencing at the Southwest Quarter of said Section 2;thence S90100'00"E, 98.06
feet along the South line of the Southwest Quarter of said Section 2; thence
N00°00'00"E, 33.00 feet to the Northerly right-of-way line of Lincoln Way to the
Point of Beginning; thence S90°00'00"E, 298.01 feet; thence N00°00'00"W, 10.00
feet;thenceN90°00'00"W, 314.31 feet; thence S58020'13"E, 19.12 feet to the Point
of Beginning.
all as shown on the plat attacl d and made a part hereof.
Grantors shall not construct, ))install, erect or place any structure,,or improvement over or within the
area of this easement, except for drives and landscaping not inconsistent with Grantee's use, and
pursuant to Iowa Department Of Transportation regulation and permit, if required, without first
obtaining the written consent of the Grantee.
Grantors shall not change the grade, elevation or contour of any part of the area of this easement
without first obtaining the written consent of the Grantee.
Grantee shall have the right to remove any unauthorized obstructions, improvements or structures
placed, installed, constructed or erected on the area of this easement.
Grantee shall assume liability for all damage to the real estate described herein due to the use of this
easement by Grantee; and upon completion of any construction, reconstruction, repair or

maintenance, Grantee shall restore the easement area to a safe and useable condition, and to a
condition substantially the same as before any such construction, reconstruction, repair or
maintenance.
Grantor shall not be liable or responsible for the cost of any improvements made or constructed in
the easement area by Grantee, or for any repairs or maintenance of such improvements.

State of Iowa, personally appeared James W. Hubbell III, to me personally known, who, being by
me duly sworn, did say that he is the President of Hubbell Realty Company, the Managing
Member of Grand Junction, L. C., an Iowa limited liability company, executing the within and
foregoing instrument; that said corporate Managing Member and said limited liability company
have no seal; that the instrument was signed on behalf of said corporate Managing Member by
authority of its Board of Directors and on behalf of the limited liability company by authority of
the Members; and said James W. Hubbell III acknowledged the execution of the instrument to be
the voluntary act and deed of the corporate Managing Member and the limited liability company,
