DATE 08/24/99 COUNCIL ACTION FORM SUBJECT: RESOLUTION ACCEPTING ELECTRIC AND STREET EASEMENTS AS PART OF THE GRAND JUNCTION FINAL PLAT. ACTION FORM SUMMARY: Grand Junction L.C. (Hubbell Realty) is proposing to grant to the City an easement for existing electrical transmission facilities and future road improvements as part of the Grand Junction Subdivision. Staff is recommending that the City Council accept these easements. BACKGROUND: Grand Junction L.C. (Hubbell Realty) is in the process of requesting approval of a one lot subdivision for the purpose of seeking a zoning/building permit for property located at the northeast corner of the intersection of Grand Avenue and Lincoln Way. As part of the review of this one lot subdivision, staff has indicated that easements are needed to provide property rights for the electric transmission line that exists that is the "tie-line" between the City Power Plant and the Power Plant at ISU. The electric transmission line exists currently in a 10-foot easement, but in actuality a 30-foot easement is needed. Grand Junction L.C. has consented to the granting of the easement. In addition to the electric easement, the staff has indicated that additional property rights are needed for the contemplated construction of additional lane width for the intersection improvements at Grand Avenue and Lincoln Way. After some discussion with representatives from Grand Junction L.C., they have consented to the granting of a 10-foot street easement for the additional lane width. City Council is now being requested to accept the easements for the existing electric facilities and the contemplated future street improvements. Staff recommends that these easements be accepted. ALTERNATIVES: 1. The City Council can accept the easements from Grand Junction L.C. for electric facilities and street improvements. 2. The City Council can decide not to accept the easements for electric facilities and street improvements from Grand Junction L.C. 3. The City council can refer this issue back to staff for additional information. a ' MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This action will accept the easements for existing electric facilities and future street right-of-way from Grand Junction L.C. Although the processing of this Minor Subdivision has taken longer than has been desired by the applicant and the staff, the result of this process has enabled the developer to obtain subdivision approval in a shorter time frame than that required by a Major Subdivision, and the City has been able to secure needed easement rights for existing electrical facilities and future road improvements.
