RESOLUTION NO. 14-297
RESOLUTION ADOPTING FINAL ASSESSMENT SCHEDULE AND
AMENDING, CONFIRMING AND LEVYING ASSESSMENT FOR THE
SOUTHEAST ENTRYWAY PROJECT
WHEREAS, heretofore and in strict compliance with chapter 384 of the Code of Iowa,
this Council did, pursuant to Resolution of Necessity duly adopted, order the construction of the
Southeast Entryway Project; and
WHEREAS, the said improvement project has been duly completed, the work accepted
and the engineers having filed the final assessment schedule with respect to said improvement
project,which has been fully considered by Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames,
Iowa, as follows:
Section 1. The final assessment schedule filed by the engineers covering the Southeast
Entryway Project, the same being attached hereto and by this reference incorporated herein and
made a part hereof, shall be and the same is hereby approved and adopted.
Section 2. Each and all of the assessments upon the benefitted property in the amounts
and upon the various lots and tracts described in such final assessment schedule are hereby
confirmed and levied.
Section 3. Each of such assessments in the amount of one hundred dollars (S 100.00) or
more is hereby divided into ten (10) equal installments, as near as may be.
Section 4. All unpaid installments shall bear interest at the rate of 3.75 percent (3.75%)
per annum from the 27th day of May, 2014 (that being the date of acceptance of the work);
provided, however, that any such assessments may be paid in full or in part without interest
within 30 days after the first published notice of the final assessment schedule, such payments to
be made at the office of the City of Ames Finance Department.
Section 5. The first installment of the unpaid assessments shall be due and payable at the
office of the County Treasurer of Story County on the first day of July, 2015, and shall become
delinquent after the first day of October, following the due date, including those instances when
the last day of September is a Saturday or Sunday, and will draw additionally the same
delinquent interest as ordinary taxes.
Section 6. Succeeding installments shall become due and payable in like manner on the
first day of July in each of the succeeding ten years, 2015 through 2025 inclusive.
Section 7. All unpaid installments of any kind may be paid in full on any date in which
the case interest shall be computed on the outstanding balance to the first day of July following
the date of such payment; and upon the payment of any installment, interest shall be computed
upon such installment to said first day of July following the date of payment.
Section 8. The City Clerk is hereby authorized and directed to certify and file the final
assessment schedule, herein referred to, with the County Treasurer of Story County, and the
Clerk shall thereupon give notice of such certification and filing by publication once each week
for two successive weeks in the Daily Tribune, a legal newspaper printed wholly in the English
language, published at least once weekly and of general circulation in Ames, Iowa, the first
publication to be not more than 15 days after the date of filing of the said schedule with the
County Treasurer, and the Clerk shall mail said notice by mail to each property owner whose
property is subject to the assessment for said improvement, said notice to be mailed on or before
the second publication of said notice.
Section 9. Said notice shall be in form substantially as follows:
NOTICE OF FILING OF FINAL ASSESSMENT SCHEDULE FOR
SOUTHEAST ENTRYWAY PROJECT, AMES, IOWA
TO WHOM IT MAY CONCERN: Take notice that the City Council of Ames,
Iowa, has adopted a final assessment schedule covering the Southeast Entryway
Project, which was duly certified to the County Treasurer of Story County, Iowa,
on the 27th day of May, 2014, all in accordance with section 384.60 of the Code
of Iowa.
Property within the following described boundaries shall be assessed by reason of
such improvement project:
Assessment Boundaries
The Northwest '/< of the Northwest `/4 of Section Thirteen (13), being part of
Parcel "E" referenced from plat of survey file in the Story County Recorder's
Office under instrument number 98-12413, Township Eighty-Three (83) North,
Range Twenty-Four (24) West of the 51h P.M., included in and being a part of the
City of Ames, Story County, Iowa;
Now Known As: Lots 1, 2, 3, and Outlot A of Deery Subdivision, Ames, Story
County, Iowa.
Any assessment may be paid in full or in part without interest within 30 days after
first published notice of the final assessment schedule that is not later than the 6th
day of December, 2014, such payments to be made at the office of the City of
Ames Finance Department. Assessments in the amount of One Hundred Dollars
($100.00) or more which are not paid in full within the aforementioned time
period will be divided into ten (10) equal annual installments due on the I"day of
July, commencing July 1, 2015. All unpaid special assessments will draw annual
interest at 3.75 percent (3.75%) computed initially from the date of acceptance of
the work for the Southeast Entryway Project, to July 1, 2015, and thereafter
computed from the July 1 immediately preceding the due dates of the respective
installments to the July 1 next following the due dates of the respective
installments. Each installment will be delinquent on October 1 following its due
date, including those instances when the last day of September is a Saturday or
Sunday, and will draw additionally the same delinquent interest and the same
penalties as ordinary taxes.
Any property owner may elect to pay one-half of any annual installment of
principal and interest of the special assessment in advance with the second semi-
annual payment of ordinary taxes collected in the year preceding the due date of
such installment.
Reference is hereby made to said final assessment schedule for a description of
the particular lots or tracts and the amounts of the final assessments thereon, as
determined and fixed by the City Council.

Section 10. Any and all resolutions or parts of resolutions in conflict herewith shall be
and the same are hereby repealed to the extent of such conflict.
