I OZ584 ° Lip FOR Re ; OCT 1 71980 yL WATER MAIN EASEMENT ®r SUSAR L.P®ITER Reorder K14OW ALL PERSONS BY THIS INSTRUMENT: That we, the under- signed, sometimes hereinafter referred to as GRANTOR, in con- sideration of One Dollar and other good and valuable consider- ation, do hereby grant unto the City of Ames , Iowa, a munici- pal corporation, its successors and assigns , hereinafter refer- red to as GRANTEE, upon the conditions hereinafter recited, the perpetual right to enter upon the land hereinafter described for the purposes of this easement and the perpetual right to construct , reconstruct , cover over, clean up , operate, use, maintain and repair water mains over , upon, across and under a strip of land situated in Story County, Iowa, described as follows : A permanent easement 5 feet on each side of the fol- lowing described centerline : Beginning at a point on the South line of Lot 1, Gateway Center Subdivision of the City of Ames , Story County, Iowa, which is N 89°29 ' 55" W, 11. 9 feet from the SE corner thereof; thence N 32°13.' 38" W, 192 . 87 feet ; thence North, 59 .95 feet ; thence West, 253 . 91 feet; thence North, 272 . 23 feet; thence N 45°00 ' 00" W, 230 . 03 feet ; thence N 45°00' 00" E , 290 . 09 feet ; thence East, 325 . 53 feet to the East line of said Lot 1, (said point being S 00°02 ' 40" E, 108 . 0 feet from the NE corner thereof) . A permanent easement 5 feet on each side of the fol- lowing described centerline : Beginning at a point on the West line of Lot 2 , Gateway Center Subdivision of the City of Ames , Story County, Iowa, which is S 00°02' 40" E, 108 . 0 feet from the NW corner thereof; thence S 83°48' 30" E, 119 . 15 feet ; thence S 80°18' 00" E, 573 . 8 feet; thence S 27°12 ' 00" E, 183. 75 feet to a point on the northwesterly line of Lot A (in said Gateway Center Subdivison) , which is S 60°28 ' 10" W, 12 . 75 feet from the most westerly corner of Lot 3 , Gateway Center Subdivision. The foregoing rights are granted by the undersigned and shall be accepted and exercised by Grantee , subject to perfor- mance by Grantee, of the following terms and conditions : 1. Grantee shall assume responsibility for all damage to the above described real estate caused by its failure to use due care in the exercise of the rights granted herein. 2 . Immediately following installation, reconstruction or repair of the aforesaid municipal utility service , weather and season permitting, the ground disturbed by construction activity shall be restored to its natural grade and previous condition. 3 .
