Kurt,
Diane Voss asked me to contact you related to outstanding development fees for the lots in the
Eastgate Subdivision currently held by First National Bank. As you probably know, the developer
of this subdivision went through a bankruptcy process. Much of the fees and outstanding
changes due to the City were paid either through the bankruptcy settlement process or by First
National Bank after they become owners of the property. The fees remaining are related to the
allocation of the cost of improvements to Dayton Avenue and are due upon sale or transfer of
ownership. The amounts due by property are provided below and in the attached spreadsheet.
Please let me know if you need any additional information.

From our meeting I recall that we determined that the outstanding fees would be due to the City upon sale
nr development by First National.
Judy, I think you found some specific language-would you like to respond to Kurt? Otherwise | can
simply respond that the fees are due when Friedrich purchases the lots.

For clarification--if we bought all of the lots from the bank..,with the intention of marketing and selling off
sites...wewouldn't be responsible for paying these fees until Friedrich sold a lot or lots to o third party? |.
E. When Friedrich sells 1428 Boston to"John Smith", we would pay$6510 to the COA.
