I have followed up with Tom at First National. They are not currently working with buyers for any of the
lots at Eastgate, but intend to more actively market the lots for sale. Tom would like to know if he needs to
work in the Dayton Avenue costs as part of sales price or disclosure as a cost to develop. Please let me
know and I will respond to Tom.

John, Steve, and Diane,
A little over a year ago I received a request from Tom Pohlman of First National in Ames related to the
cost allocation for Dayton Avenue Improvements and tapping fees for Eastgate Subdivision. I provided
Tom with the amounts allocated to each of the lots owned by First National. Tom called recently and
asked about when the Dayton Avenue cost allocation assessment is due, upon sale of the property or
upon development. Diane and I have reviewed and are not clear. This subdivision has been a little
different because of the bankruptcy of the initial developer and the taking over of properties by lenders. If
anyone could provide some clarification on when payment of the Dayton Avenue cost allocation is due I
will pass on to Tom.

I have researched our files to determine the status of this, and have found that we have released all bonds
to secure public improvements (see Resolution 02-361). However, it appears that we intended to collect
utility tapping fees of$12,901 on a lot-by-lot basis as lots are developed (see Resolution 01-051) Also, it
appears that an "arrangement" between the developer and developer's creditors defining obligations
under the Subdivision Ordinance provided that payments of$44,746.39 for city street lights, escrowed
funding of for a bike path, and $18,746.39 for City engineering and inspection costs be paid from the
proceeds of each pending lot sale. A letter from John Klaus of April 14, 2003 indicated that$9,000 was
owed for the sale of Lot 5 for this purpose, and that permits would not be issued until payment was made.
I assume that the$9,000 amount was owed for each lot, but I don't have anything to verify that. Also, I
don't know how much of the total amount has been paid to date.

To all,
I have not heard back from anyone related to when payment is due for the Dayton Avenue improvement
cost allocation to Eastgate Subdivision.
First National Bank still owns much of the undeveloped portion of the subdivision due to bankruptcy of the
original developer. There are interested in more actively marketing the property for sale and would needs
to disclose when payment is due for Dayton Road. I have gotten back to Tom that I would need to check
into this more.
Anyone have any input so that I can respond back to Tom or should I refer he to another department?
