As we just discussed, paragraph 2 of the Eastgate Subdivision Covenant for assessments provides that
the amount of the assessment shall be"...by action of the governing body of the City...". Therefore,
setting the amount of the assessment to be apportioned to the remaining unsold lots should be by
resolution of the City Council. It is my understanding that you will prepare the council action form for the
Councils meeting of November 23.

John,
I found the work sheet for the Dayton cost estimate in the file and the original figure of$141,000 didn't
include contingency or engineering. Considering these two factors, along with new unit prices, the revised
amount is$210,000.There is also a tapping fee calculated at$12,901.01. Certain lots have already been
paid, of which Finance should have a record. I found a spreadsheet showing the per lot percentage
breakdown that I will bring to you tomorrow(Thursday).
