The undersigned, the Mayor and the City Clerk of the City of Ames, Iowa, for valuable
consideration,receipt of which is hereby acknowledged, do hereby acknowledge that the following-
described real estate situated in Story County, Iowa, to-wit:
Lots 4 and 20, Eastgate Subdivision, Story County, Ames, Iowa
is hereby released from any and all obligations pursuant to the Development Agreement Eastgate
Subdivision (the "Agreement") entered into by and between Eastgate Development, Inc., and the
City of Ames on October 6, 1998, and filed on October 16, 1998, as Instrument No. 98-14377 in the
office of the Recorder of Story County, Iowa.
The Agreement remains in full force and effect against all other real estate covered by the
Agreement.

appeared Ted Tedesco and Diane R. Voss, to me personally known, who being by me duly sworn
did say that they are the Mayor and City Clerk of the City of Ames, Iowa, respectively; that said
instrument was signed on behalf of said City of Ames, Iowa; and that said Ted Tedesco and Diane
R. Voss as Mayor and City Clerk acknowledged the execution of said instrument to be the voluntary
act and deed of the City of Ames, Iowa,by it and by them voluntarily executed.
