COUNCIL ACTION FORM
SUBJECT: MOTION TO WAIVE PRELIMINARY PLAT REQUIREMENTS AND
RESOLUTION APPROVING THE FINAL PLAT OF THE EASTGATE SUBDIVISION.
ACTION FORM SUMMARY: The applicant, Eastgate Development, Inc., is requesting that
the City Council approve the Final Plat of the Eastgate Subdivision.
Staff is recommending that the Final Plat of Eastgate Subdivision be approved.
BACKGROUND:
Eastgate Development, Inc. (Steve Davis) is requesting that the City Council approve the
Final Plat of the Eastgate Subdivision. The proposed subdivision includes 23 lots that
range in size from .8 acres to 5.51 acres. The property is zoned G-C (General
Commercial). All lots meet or exceed the zoning requirements.
ANALYSIS:
As part of the administration of the new subdivision regulations, staff is attempting to
streamline the review and approval process and have all subdivisions that are processed
after October 1, 1999 be reviewed under the same regulations. Prior to this position, staff
was attempting to continue to administer the old subdivision regulations for plats that were
in process prior to the effective date of the new regulations. This approach created
extensive confusion. With this revised review procedure, it is still necessary for the
applicant to comply with all of the requirements of the new regulations. As such, there is
a requirement now that the review procedures that would have occurred in the Preliminary
Plat phase of the new regulations be waived in order to comply with the new requirements.
The City Council is being requested to waive the requirements of Section 23.302(1) of the
new regulations. The ability to waive this requirement is found in Section 23.103 of the
new subdivision regulations. Additionally, this waiver is limited only those subdivisions that
are now seeking a Final Plat approval after the effective date of the new regulations where
a "Conceptual Development Plan" had previously been approved under the old regulations.
The staff has reviewed the Final Plat of the Eastgate Subdivision to determine compliance
with City requirements. The developer has installed underground infrastructure, including
water mains, sanitary sewer mains, and storm sewer mains. These improvements have
been inspected by the City and are now being proposed for acceptance as part of the
approval of this plat. In addition, the developer has submitted an Improvement Agreement,
along with a bond for financial security to the City to ensure the installation of street
improvements and other appurtenances.
Based on the review of the regulations of the City, it has been determined that the
Eastgate Subdivision meets the requirements of the City and staff is recommending that
this Final Plat be approved.
ALTERNATIVES:
1. The City Council can approve the.Final Plat of the Eastgate Subdivision.
2. The City Council can approve the Final Plat of the Eastgate Subdivision with
modifications.
3. The City Council can deny approval of the Final Plat of the Eastgate Subdivision.

MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve the Final Plat of the Eastgate Subdivision. This will enable the
development of this Community Commercial Node along the East 13th Street gateway to
the City of Ames.
